Carlsbad; and
WHEREAS, notice of the public hearing of the proposed reclassification
ras published on the 15th day of April, 1965, and
WHEREAS, on the 27th day of April, 1965, the Planning Commission
)f the City of Carlsbad held and conducted a duly advertised hearing on said
xoposed reclassification; and
WHEREAS, at said meeting of the Planning Commission, Resolution No.
394 was adopted wherein the request for reclassification was denied; and
WHEREAS, on the 7th day of May, 1965, a written appeal was
received by the City of Carlsbad from Jay Lear, Inc., which appeal in effect
requested the City Council to consider the action of the Planning Commission
in denying the request €or reclassification of the above-mentioned property; and
WHEREAS, on May 20, 1965, notice of a public hearing on said appeal
was published; and
WHEREAS, on June 1, 1965, a public hearing was held in the City Hall
2960 Pi0 Pic0 Drive, Carlsbad, California, at 7:30 P.M., at which time the
appeal was considered by the City Council and evidence and arguments were
presented by all interested parties.
NOW, TITEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad that the findings of the Planning Commission in denying the
RESOLUTION NO, 1154
A RESOLUTION OF THE: CITY COUNCIL OF TKE CITY OF CABLSBAD DENYING THE
REQUEST FOR RECLASSIFICATION OF
CERTAIN PROPERTY IN THE CITY OF CARLSBAD, FROM ZONE R-3L TO ZONE C-1.
WHEREAS, on April 9, 1965, Jay Lear, Inc., applied for a reclass-
ification from Zone R-3L to Zone C-1 on property located on the Southwest
corner of the intersection of Chestnut Ave., and Monroe St. in the City of

1. There is no need in this area for more of the uses permitted in
le proposed zone.
2. The location directly across the street from Carlsbad High
chool and one block from Magnolia Elementary School is less suitable for
he purposes permitted in the proposed zone.
3. It would create an extreme traffic hazard for the hundreds of
;chool children using the public thoroughfares,
BE IT FURTHER RESOLVED that €or the foregoing reasons the appeal
.s hereby denied.
BE IT FURTHER RESOLVED, that the City Clerk is hereby directed
;o cause a copy of this resolution to be mailed to the appellants, and a copy
if this resolution to be attached to the Planning Commission file and returned
to the Planning Commission for permanent filing.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Carlsbad held on the 1st day of June, 1965, by the
following vote, to wit:
AYES: Councilmen Dunne, Neiswender, Atkinson, Hughes and Jardine
