RESOLUTION NO. 1182
A RESOLUTION OF THE CITY COUNCIL
ENGINEER AND FIXING COMPENSATION. HE CITY OF CARLSBAD, APPOINTING
(Proposed Assessment District No. 4-1964)
RESOLVED by the City Council of the City of Carlsbad that
Wayne P. Lill be, and he is hereby appointed Engineer of Work for
the propased doing of all necessary engineering work and exercising
all of the functions provided for the office of Engineer of Work
and Seperintendent of Streets in the "Improvement Act of 1911" in
connecta"or?r with the improvement work in the City of Car'lsbad, and
to be kpw~ as the improvement for Downtown Street Lighting; and
BE IT FURTHER RESOLVED that said Wayne P. Li71 shall act as
En;-ineer of Work and Superintendent of Streets and is hereby employ
ed and appointed to furnish all surveys, original drawings, maps
and blue prints, including any and all such maps necessary and in-
cident to the rights of way contemplated in the improvement work
herein involved; all plans and specifications, all inspection work,
and any ancl all other services which shall be required from the
Engineer of Work and/or Superintendent of Streets under the provi-
sions of the "Improvement Act of 1911''3 excepting preparation of
assessmerzt rolls assessment diagram and warrant.
BE IT FURTHER RESOLVED that for such services that the said
Wayne P. Lill acting in his capacity as City Engineer of the City
of Carlsbad shall receive as ancl for his compensation for the servi
so specified, and as provided by law, the following compensation,
which compensation shall be payable to the General Fund of the City
of Carlsbad, and shall consist of the following sums of money:
(a) Ten percent (10%) of the contract price for engineering services e
BE IT FURTHER RESOLVED that said sum shall be based upon the
contract price without incidentals; and in the event the proposed

proceedings herein contemplated shall be defeated or for any reason
fail of consummation, that the said Wayne P. Lill of the City of
Carlsbad shall not receive any compensation; and
BE IT FURTHER RESOLVED that the fees hereinabove provided to
be paid to the said Engineer shall be payable as follows:
(a)
(5)
Three-fourths (3/4ths) of the Engineering Fee upon awarding and signing of contract for the work.
The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the Assessment and delivery of the Warrant.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 7th day of September,
1965, by the following vote, to wit:
AYES: Councilmen Dunne, Neiswender, Atkinson, Hughes and Jardi
