RESOLUTION NO. 1221
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN STREET IMPROVEMENTS AND APPURTENANCES AND APPURTENANT WORK IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT: DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID MORK AND TO BE ASSESSED TO PAY THE COST AND EXPENSE THEREOF: DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT ASSESSMENTS TO BE LEVIED; AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO SAID NORK OR THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH, AND GIVING NOTICE THEREOF.

HE WEB^ RESOLVE, DETERMINE AND ORDER as foi lows: i Section 1. That the public interest and convenience require
and that it is the intention of the City Council of said City of
Carlsbad to order the following work to be done or improvements to

The construction of certain street improvements and appurten-
ances and appurtenant work on Madison Street in said City,
intersection with Elm Avenue; thence southerly to its intersection
with Magnolia Avenue, be cleared, grubbed and graded; that the
subgrade be prepared and paved with two inches (2") of asphaltic
concrete surface course with chip seal coat laid upon four inches I (4") of compacted and primed base material; Portland Cement concrete1

curb and gutter, sidewalks, driveway approaches, depressed curb sec- I
I tions, spandrels and cross gutters; adjustment of existing sewer
1 I manholes and dead-ends to grade; reinforced concrete curb inlets;
reinforced concrete drainage conduit; precast concrete drainage I manholes; vitrified clay pipe sewer laterals be constructed therein;! i
that portion of Oak Avenues in said City, from its intersection withi
Roosevelt Street; thence easterly to its intersection with Jefferson
Street, be cleared, grubbed and graded; that the subgrade be pre-

course with chip seal laid upon four inches (4") of compacted and
primed base material; Portland Cement concrete curb and gutters,

asphaltic concrete surface course with chip seal laid upon four
inches (4") of compacted and primed base material; Portland Cement
concrete curb and gutter, sidewalks, depressed curb section; adjust-
ment of existing sewer manholes to grade; vitrified clay pipe sewer
laterals be constructed therein; that portion of Jefferson Street,
in said City, from its intersection with Magnolia Avenues thirty
point forty-six feet (30.46') southerly be cleared, grubbed and 1
graded; Portland Cement concrete curb and gutter, sidewalks, spandre s
and cross gutters be constructed therein; that the said work herein- i i before described shall be done to the official grades shown with the
exact nature, extent and location of said improvements to be in
accordance with detailed plans on file with the City Clerk of the
City of Carlsbad, containing twenty sheets entitled "Construction
Plans for the Improvement of Madison Street, et. al", Project 4-44,

The estimated cost of said work or improvement, inclusive of
incidental expenses, is the sum of $163,696,00.
Section 2. That all the aforesaid work or improvement shall
be constructed at the gradesg along the lines, between the points.,
of the dimensionsoat the places and in the manner shown on the plans
(which include profiles and detailed drawings) for said work, des-
ignated "Construction Plans for the Improvement of Madison Street,
et al"', Project 4-44, Drawing No. 145-8, consisting of twenty sheets
and in accordance with said plans and with the specifications for
said works which are designated "Contract Documents and Specificatio
!doq 5-1964", Said plans and specifications were heretofore approved
by this City Council, and are on file in the office of the City Cler
of said City in the City Hall in said city, and reference is hereby
made to said plans and specifications for the full and detailed
description of said proposed work and for a description of the grade
at which said work is to be done.
Section 3. That in the opinion of this City Council the said
contemplated work is of more than local or ordinary public benefit
and this City Council hereby makes the expense of said work charge-
able upon a district, which district this City Council hereby declar
to be the district benefited by said work and to be assessed to pay
the cost and expense thereof. For a description of said district
reference is hereby made to a plat or map of said district hereto-
fore approved by this City Council, on file in said office of the
City Clerk and designated "Assessment District No. 5-1964 Plat",
which map or plat indicates by a boundary line the extent of the
territory included in the said proposed district and shall govern
for all details as to the extent of said assessment district.
Section 4. That serial bonds bearing interest at the rate Qf
six percent (6%) per annum shall be issued to represent each assess-
ment of fifty dollars ($50.00) or over remaining unpaid for thirty

a description of the property in which each signer thereof is
interested, sufficient to identify the same and shall be delivered
to and filed with the City Clerk, City of Carlsbad at 2960 Pi0 pic0

property which is proposed to be assessed to pay any part of the
cost of said work, whose names and addresses appear on the last
