A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD OVERRULING ALL PROTESTS ON TKE ASSESSMENT, CONFIRMING THE REGULARITY OF PROCEEDINGS.
(Assessment Dis tri ct No. 2-1966)
WHEREAS, on the 25th day of September, 1969, the Superintendent of Streets
filed with the City Clerk of the City of Carlsbad his assessment to represent
the cost and expenses of the work and improvement for the work done,
inca'dental expenses, of constructing certain sewer improvements in the City of
Carlsbad, ordered by Resolution No. 1538 of the City of Carlsbad, and as said
work and improvement was done by Carlsbad Pipelines, Inc. said work being more
particularly described in Resolution of Intention No. 1539; and
WHEREAS, the City Clerk of the City of Carlsbad has duly given notice of
publication and mailing in the time and manner provided by law of the filing of
said assessment and of the time of hearing thereon; and
WHEREAS, the City Council of the City of Carlsbad has taken sai
under considerati on and has recei ved all oral and documentary evi dence, and any
and all protests, relating to the assessment proceedings heretofore had, and the
proper completion of the work and improvement for which the assessmnt has been
i ss ued.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Carlsbad that all protests, if any, as the same appear upon the minutes of the
City Council of the City of Carlsbad at the date set for hearing, be, and they
are hereby overruled.
BE IT FURTHER RESOLVED that all proceedings prior to the date of hearing,
relating to said assessment, and all acts and determinations of all officers
and employees of the City of Carlsbad, in relation to said assessmentg be, and
the same are hereby ratified and confirmed.
BE IT FURTHER RESOLVED that said assessment and the diagram and warrant
attached thereto, be, and the same is hereby confirmed by the City Council of
the City of Carlsbad.
