A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD GRANTING AN APPEAL OF THE DECISION OF
CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF A MOBILE HOMES PARK
THE PLANNING COMMISSION REGARDING A PRE-ANNEXATION

1. Appellant ANDREW MC REYNOLDS appealed to the City Council
the action of the Planning Commission regarding his herein
mentioned application - Planning Commission Resolution No. 650.
2. All steps required by law in connection with said applica-
tion and appeal have been complied with.
3. Said appeal and application are granted and the following
action in regard thereto is taken: Pre-Annexation Conditional Use

4. In the opinion of the City Council the following facts
and reasons make the granting of said application necessary to I 161/ carry out the general purpose of Ordinance No. 9060 as amended:

(a) It will conform to the General Plan of the City.
(b) It will not be detrimental to the surrounding area of the City.
5. Said action regarding said application is made subject to
the following conditions and limitations:
A. As shown on Exhibit A, a revised development plan showing
Las Encinas Road, revised open space and mobile home locations East
of said Las Encinas Road, shall be submitted to the Planning and
Engineering Departments for review.

Park, as submitted by the developer, shall not exceed 590 units.
C. That area West of Las Encinas Road,as recommended for
mobile homes development by City staff, shall be developed with open
space as shown on Exhibit A, and at a density not to exceed 6.5
units per acre.

D. The final alignments and construction details of all in-
terior private streets, Lowder Lane, and Las Encinas Road, shall be
subject to approval of the Engineering Department.
E. Las Encinas Road, 84 ft. right of way, shall be dedicated
immediately between the Southerly boundary of the development and
Palomar Airport Road, and improved prior to an authorization to
occupy any space shown in Phase 3, Exhibit A. The developer shall
enter into a separate standard, bonded, subdivision agreement,
assuring completion of the road, or such other agreement as may be
satisfactory to the City Attorney.
F. That all public improvements be constructed as required
by ordinance and, the City Engineer; design shall be in accordance
with City of Carlsbad standard design criteria dated January 1970.
G. That Standard Subdivision Bonds and agreement be provided
to guarantee completion of public improvements.
H. That a Parcel Map or Subdivision Map, as appropriate, be
filed prior to issuance of any permits for graddmgor building.
I. Those portions of proposed Lowder Lane affected by the
proposed mobile homes park shall be constructed to City Standards
by the developer and dedicated to thecity of Carlsbad prior to
issuance of an authorization to occupy any space shown in Phase 2,
Exhibit A.
J. That the proposed street between Lowder Lane and the West
property line shall be private with a minimum 40-foot travelway.
All connections between private streets and public streets shall be
clearly designated.
K. That a grading plan be submitted to the Engineering Depar
ment for review and approval, prior to issuance of any building
permits.
L. That all drainage facilities be constructed in accordance
with City standard design criteria and, as approved by the City
Engineer.

with the State of California Administrative Code, Title
25, Housing and Community Development, Chapter 4, Mobile
Homes Parks.
P. That all open space areas be landscaped in conformance
with City Ordinance No. 9181, and it shall be the respons.

Q. That all slopes be panted with combinations of ground
cover, shrubs and trees.
R. That subject mobile homes park be encompassed by a six-
foot (6-ft.) high, decorative masonry wall.
S. That a concept of architecture be adopted for the project
and, that all elevations for the project be subject to
review and approval by the Planning Commission.
T. Fire hydrants and water mains to supply them, shall be
constructed as follows and any deviation therefrom shall
be approved by the Fire Chief and City Engineer:
(1) The standard minimum size of mains used for hydrant suppl:
(a) For residential districts (the mobile home park to be
considered as a high density, residential district),
8-inch; 6-inch to be used only where it completes a
gridiron and in no case in blocks 600 feet or more in
1 ength.
(2) Hydrants - as per specifications on file with City Engi-
neer and the Water Department.
(a) Residential area, one to each 120,000 square feet, no'
to exceed 300 feet apart;
(b) On-site as well as off-site hydrants within the an-
nexed area, will be required. The location of all

hydrants shall be approved by the Fire Department.
That sewer service be provided by the City of Carlsbad
and that all trunk lines be constructed to ultimate size
by the developer.
That the Conditional Use Permit is subject to annexation
to the City of Carlsbad and, that said permit shall be-

come void if development has not begun within one (1) yei
after its granting.
That the total property shall be annexed to the City of
Carlsbad as one (7) parcel.

PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held March 3, 1970, by the follow-
ing vote, to wit:
AYES: Councilman Dunne, McComas, Neiswender, Jardine and
Castro.
HAYES: None
ABSENT: None.
