RESOLUTION NO. 1706 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING INTENTION TO VACATE PORTIONS *OF PUBLIC RIGHTS OF WAY
The City Council of the City of Carlsbad does hereby
resolve as follows:

The City Council of the City of Carlsbad does hereby
declare its intention to vacate those certain portions of
public rights of way in Scott Drive and an alley located
southerly of Yourell Avenue and westerly of Lot 26,
iebarr Estates No. 2, in the City of Carlsbad, County of
San Diego, State of California, particularly described
on the maps of said proposed vacations on file in the
office of the City Clerk of the City of Carlsbad, 'to
which maps reference is hereby made for further particulars.
Proceedings for said vacations are taken subject to the
reservation and exception from said vacations of permanent
easements and rights at any time, or from time to time, to
construct, maintain, operate, replace, remove, and renew
sanitary sewers and storm drains and appurtenant structures ,
in, upon, over, and across any portion of said proposed
vacation, and pursuant to any existing franchises or renewal
thereof, or otherwise, to construct, or maintain, operate,
replace, remove, or renew, and enlarge lines of pipe,
conduits, cables, wires, poles, and other convenient
structures, equipment and fixtures, for the operation of
gas pipe lines, telegraphic and telephone lines, railroad
lines, and for the transportation or distribution of
electrical energy, petroleum and its products, ammonia,
water, and incidental purposes, including access and a
right to keep the property free from inflammable materials
and wood growth, and otherwise protect the same from all
hazard in, upon, and over said proposed vacations.
