RESOLUTION NO. 3058
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING AMENDMENT TO SECTIONS 21.08.040, 21.10.040 AND
21.12.040 OF THE CARLSBAD MUNICIPAL CODE PROVIDING FOR REVISIONS OF THE SIDE YARD SETBACKS APPLICABLE TO THE R-A, R-1 AND R-2 ZONING DISTRICTS.
WHEREAS, on the 23rd day of January, 1973, the Carlsbad Cit
Planning Commission adopted Resolution No. 864, which is herewith
referred to and made a part hereof; and
WHEREAS, on February 6, 1973, a duly advertised public
hearing was held to consider the proposed amendment to Sections
21.08.040, 21.10.040 and 21.12.040, of the Carlsbad Municipal
Code and continued to February 20, 1973, and
WHEREAS, the City Council received all recommendations and
heard all persons interested in or opposed to the proposed amend-
nent; and
WHEREAS, the City Council after hearing all recommendations
referred the matter back to the Planning Commission for further
report; and
WHEREAS, on February 27j 1973, the Planning Commission did
review and consider proposed changes to the amendment and did
report back to the City Council;
NOW, THEREFORE, the City Council of the City of Carlsbad
does hereby find- and adopt as the findings of the City Council
the recommendations of the Planning Commission as set forth in the
above referenced resolution and report of the Planning Commission.
IT IS HEREBY CERTIFIED by the City Council that the approva
of the proposed amendment is necessary to carry out the general
purpose of Ordinance No. 9060, as amended.

IT IS HEREBY DECLARED by the City Council of the City of
larlsbad that said City Council intends to adopt an ordinance to
:ffectuate the proposed amendment.
PASSED, APPROVED AND ADOPTED at a regular adjourned meetin!
if the City Council held on the 7th day of March, 1973, by the
'ollowing vote, to wit:
AYES: Cmn. Dunne, McComas and Chase.
NOES: None.
ABSENT: Cmn. Lewis and Frazee.
