requirements in regard to public works contracts in certain
emergency situations; and
WHEREAS, the Pine Avenue storm drain has collapsed
resulting in a flooding of Carlsbad Boulevard and created
an emergency situation requiring immediate action to protect
private property in the area and to insure the safety of
motorists using said roads; and
WHEREAS, the City has received informal bids from four
contractors for the work necessary to repair said condition; and
WHEREAS, the Don Hubbard Contracting Company of Encinitas
has submitted the low bid of $5,935.25;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the public interest and necessity demand the
immediate expenditure of public money to safeguard life, health,
and property in the City of Carlsbad by repairing the Pine
Avenue storm drain.
3. The Public Works Director is hereby authorized to
accept the bid of Don Hubbard Contracting Company for the
performance of said bid and is authorized to execute a

contract for the same in the amount of $5,935.25.
PASSED, APPROVED AND ADOPTED by the City Council of the
City of Carlsbad at a regular meeting held March 20, 1973,
by the following vote, to wit:
AYES : Councilmen Dunne, McComas, Lewis and Frazee.
NOES : None.
ABSENT: Counci lman Chase.
