A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ANNOUNCING FINDINGS AND DECISION ON A CHANGE OF ZONE FROM R-1 AND C-1 TO C-2 (ZC-121) ON PROPERTY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF THE INTER- SECTION OF PI0 PIC0 DRIVE AND ELM AVENUE.

WHEREAS, on July 10, 1973 and August 14, 1973, a duly adver-
tised public hearing was held before the Planning Commission to
consider a request for a Change of Zone from R-1 and C-1 to C-2
(ZC-121) to allow construction of a two-story complex to be used
for commercial and professional activities, on property generally
located at the southeast corner of the intersection of Pi0 Pic0
and Elm Avenue, and more particularly described as:
That portion of Lots 17 to 24, inclusive, in Block 86 of the Town of Carlsbad, in the County of San Diego, State of California, according to map thereof, No. 535, filed in the Office of the County Recorder of San Diego County, May 2, 1888: TOGETHER with a por- tion of Tract 115 of the Town of Carlsbad, County of San Diego, State of California, according to Map there- of No. 775, filed in the Office of the County Recorder of San Diego County, February 15, 1894.
WHEREAS, at the conclusion of said hearing on August 14,
1973, the Planning Commission of the City of Carlsbad did adopt
Resolution No. 942 recommending Denial of the zone change; and
WHEREAS, on September 4, 1973 the City Council of the City
of Carlsbad held a public hearing on the appeal of said Denial,
received all recommendations and heard all persons interested in
or opposed to the proposed change of zone and indicated their in-
tent to grant said appeal, and referred the matter back to the
Planning Commission for report; and
WHEREAS, on September 25, 1973, the Planning Commission was
presented a report describing City Council Action regarding the
COLONIAL MALL/ROBERT L. WATSON'S request for a Change of Zone,
and at the conclusion of said presentation adopted Resolution
No. 967 recommending said zone change, herewith referred to and
made a part hereof; and
WHEREAS, said application has complied with the require-
ments of the "City of Carlsbad Environmental Protection Ordinance
of 1972" and the Planning Director has determined that the pro-
ject will not have any significant effect on the environment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Comission contained
in the aforementioned Resolution No.967 constitute the findings
of the Carlsbad City Council.
3. That the approval of the proposed change of zone clas-
sification is necessary to carry out the general purpose of
Title 21 of the Municipal Code.
4. That the City of Carlsbad City Council intends to adopt
an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the 16th day of October , 1973, by the
following vote, to wit:
AYES: Counci1men Dunne, McComas, Chase and prazee.
NOES: Councilman Lewis.
