HomeMy WebLinkAbout1973-10-16; City Council; Resolution 3250z 2 3 4 5 6 7 8 9 30 11 12 13 14 15 16 17 18 19 2c 21 22 2: 24 2t 26 27 2E 2s 3( 31 3; RESOLUTION N0.3250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS TO ALLOW THE DEVELOPMENT OF A LOT CONDOMINIUM PROJECT PROVIDING A MAXIMUM OF 1026 UNITS ON 96 ACRES OF PROPERTY GENERALLY LOCATED SOUTHERLY OF AND ADJACENT TO LA COSTA AVENUE, IMMEDIATELY WESTERLY OF THE PRESENT WESTERLY MOST EXTENSION OF LEVANTE STREET, TO BE KNOWN AS SPANISH VILLAGE WEST. APPLICANT: LA COSTA LAND CO. AND DECISION AND ADOPTING SPECIFIC PLAN (SP-119) WHEREAS, a duly advertised Public Hearing was held September 25, 1973, in the manner prescribed by law to consider the Specific Plan (SP-119) to allow for the development of 26 Condominium lots providing a maximum of 1026 units on property described as: Portion Section 35 & 36, TownshLp 12 South, Range 4 West, and Portion of Section 2, Township 13 South, Range 4 West, S.B.M., City of Carlsbad, County of San Diego, State of California. WHEREAS, on the 25th day of September, 1973, the Carlsbad City Planning Commission adopted Resolution No. 970, which is herewith referred to and made a part hereof; and WHEREAS, an October 16 , 1973, the City Council held a duly advertised public hearing and received all recom- mendations and heard all persons interested in or opposed to the proposed Specific Plan; and WHEREAS, said application has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1.972'' and an Environmental Impact Report was presented and dis- cussed at a duly noticed public hearing held by the Planning Commission and the City Council and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 970 constitute the findings of the City Council. C. That the approval of the proposed Specific Plan is 3 i 1 4 F 6 7 E 9 10 11 12 13 14 15 16 17 18 19 20 22 22 23 24 25 26 27 28 29 30 31 32 necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code. 0. That Specific Plan No. (SP-119) is hereby approved sub- ject to the following conditions: 1. The approval of a Specific Plan is granted for the land described in the application and any attach- ments thereto, and as shown on the plot plan submitted labled Final Revised Exhibit A, dated Sept. 17, 1973. The location of all buildings, fences, signs, roadways, parking areas, landscaping and other facilities or features shall be located substantially as shown on the plat plan labeled Final Revised Exhibit A, dated September 17, 1973, except or unless indicated other- wise herein. 2. Prior to the development of each of lots 108-135, a specific plan of the proposed development shall be submitted to the Planning Commission and City Council for consideration and approval. Any minor change may be approved by the Planning rector. Any substantial change will require the ling of an application for an amendment to be con- dered by the Planning Commission. All requirements of any law, ordinance or regula- on of the State of California, City of Carlsbad and any other governmental entity shall be complied with. 5. No signs or advertising of any type whatsoever shall be erected or installed until plans therefor have been approved by the City of Carlsbad. 6. Prior to obtaining any permits, and within 30 days hereof, the applicant shall file with the Secretary of the Planning Commission written acceptance of the con- ditions stated herein. 7. Compliance with and execution of all conditions listed hereon shall be necessary unless otherwise speci- fied, prior to obtaining final building inspection clearance. Deviation from this requirement shall be permitted only by written consent of the Planning Direc- tor. 8. A detailed landscape and sprinkler plan prepared by a landscape architect shall be submitted to the Planning Director for consideration and approval. Said plan shal be for all slope areas within the development. 9. Prior to inspection clearance, all landscaping shall be installed. Said landscaping shall, at all times, be maintained in a manner acceptable to the Planning Director. 10. All utilities, including electr cable television, shall be installed shall be completely concealed from v -2- cal, telephone and underground and/or ew. ’. All public improvements shall be made in conform- ity with the subdivision ordinance and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. 12. Encinitas Union and San Dieguito Union High School Districts to provide for future school requirements that will result from the proposed development. PASSED, APPROVED AND ADOPTED at a regular meeting of the Cit: The developer is encouraged to work with the Council on the 16th day of October , 1973, by the following vote, to wit: AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee.
