RESOLUTION NO. 3303
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ANNOUNCING FINDINGS
AND DECISION ON A CHANGE OF ZONE (ZC-131 and
ZC-132) FROM R-1-10,000 (SINGLE FAMILY), TO
17.66 ACRES OF LAND GENERALLY LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF MARRON
MENT OF A SHOPPING CENTER COMPLEX.
C-2 (GENERAL COMMERCIAL) ON APPROXIMATELY
ROAD AND EL CAMINO REAL TO ALLOW THE DEVELOP-
APPLICANT: KELLY-KURLANDER, ET PGL., AND 0. VANDERBURG.
WHEREAS, a duly advertised public hearing was held on
November 27, 1973 before the Planning Commission to consider a
request for a Change of Zone from R-1-10,000 (Single Family) to
C-2 (General Commercial) on approximately 17-66 acres of land
generally located at the northeast corner of the intersection of
Marron Road and El Camino Real and more particularly described as:
Those portions of Lots 4 and 5 of Fractional
Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, in the City of Carlsbad County of San Diego, State of California, according to United States Government Survey approved December 27, 1870.
WHEREAS, at the conclusion of said hearing, the Planning
Commission of the City of Carlsbad adopted Resolution No. 1003,
recommending said zone change which is herewith referred to and
made a part hereof; and
WHEREAS, on the 18th day of December , 1973, the
City Council held a public hearing on the matter, received all
recommendations and heard all persons interested in or opposed to
the proposed change of zone; and
WHEREAS, said application has complied with the require-
ments of the "City of Carlsbad Environmental Protection Ordinance
of 1972" and an Environmental Impact Report was presented and
discussed at a duly noticed public hearing held by the Planning
Commission and the City Council and was approved as presented;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the

City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
in the Resolution No. 1008 constitute the findings of the Carlsbad
City Council.
3. That the approval of the proposed change of zone classi-
fication is necessary to carry out the general purpose of Title 21
of the Municipal Code.
4. That the City Council of the City of Carlsbad intends to
adopt an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the --__ 18th day of December , 1973, by the
following vote, to wit:
AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee.
NOES: None
ABSENT: None
