RESOLUTION NO. 3359
LUTION OF THE CITY COUNCI F THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION REGARDING CHANGE OF
ZONE FOR THE PONTO AREA FROM M (INDUSTRIAL) AND C-M (HEAVY COMMERCIAL AND LIGHT INDUS- TRIAL) TO RD-M (RESIDENTIAL DENSITY MULTIPLE)
THUS ENSURING CONSISTENCY OF THE ZONING WITH
THE LAND USE COMMITMENT OF THE GENERAL PLAN
FOR AREA NO. 2.
WHEREAS, on January 8, 1974 a duly advertised public
hearing was held before the Planning Commission in the manner
prescribed by law to consider a change of zone from M and C-M
to RD-M for the Ponto Area, thus ensuring consistency of the zon-
ing with the land use commitment of the General Plan for Area No.2
and
WHEREAS, at the conclusion of said hearing the Planning
Commission of the City of Carlsbad adopted Resolution No. 1032
recommending said zone change which is herewith referred to and
made a part hereof; and
WHEREAS, on the 19th day of February , 1974, the City
Council held a public hearing on the matter, received all recom-
mendations and heard all persons interested in or opposed to the
proposed change of zone: and
WHEREAS, said application has complied with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972 and has been declared to have a nonsignificant impact on
the environment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
in the aforementioned Resolution No. 1032 constitute the findings
of the Carlsbad City Council.
3. That the City Council determines that the existing

General Plan designation for the area multi-family residential is
the appropriate land use for the area.
to bring the zoning into conformity with that designation.
This action is necessary
4. That the existing industrial uses are becoming in-
creasingly more incompatible with the surrounding residential and
mobile home park developments, and this action is necessary to
insure that these incompatible uses do not proliferate in this
area.
5. The zone change will allow the currently existing
industrial uses to continue as nonconforming uses and will allow
them a reasonable amortization period to recover their investments
before the abatement of those uses is required, such procedure
to insure that the ultimate development of the Ponto Area will be
in accord with the land use designations of the General Plan.
6. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the 19th day of February , 1974, by the fol-
lowing vote, to wit:
