RESOLUTION NO. 3459
A RESOLUTION OF THE CITY couNcrL OF THE
CITY OF CARLSBAD, CALIFORNIA, RECITING
THE FACT OF A SPECIAL MUNICIPAL ELECTION
HELD IN SAID CITY ON THE 4TH DAY OF JUNE,
1974, DECLARING THE RESULT THEREOF AND
SUCH OTHER MATTERS AS ARE PROVIDED BY LAW.
WHEREAS, a special municipal election was held and con-
ducted in the City of Carlsbad, County of San Diego, State of
California, on Tuesday, the 4th day of June, 1974, as required by
law; and
WHEREAS, pursuant to City Council Resolutions Nos. 3378
and 3379 said election was consolidated with the statewide primary
election held on said date; and
WHEREAS, notice of said election was duly and regularly
given in time, form and manner as provided by law, that voting
precincts were properly established, that election officers were
appointed and that in all respects said election was held and con-
ducted and the votes cast thereat, received and canvassed and the
returns made and declared in time, form and manner as required by
the provisions of the Elections Code of the State of California
for the holding of elections in cities; and
WHEREAS, City Council Resolution No. 3379, adopted the 21st
day of March, 1974, authorizes the Board of Supervisors of the
County of San Diego to canvass the returns of said election; and
WHEREAS, pursuant to the Elections Code said canvass has
been completed by the Registrar of Voters who has certified the
results to said Board which has, by its Resolution Docket No.490791
adopted on the 10th day of July , 1974, certified the re-
sults to this City Council, said resolution and results are at-
tached and made a part hereof as Exhibit A.
NOW, THEREFORE, the City Council of the City of Carlsbad,
California, does resolve as follows:
1. That the above recitations are true and correct.
2. That said special municipal election was held for the
purpose of electing a member of the City Council for the unexpired
portion of a term of office in which a vacancy was created, said
term to end on March 9, 1976.
3. That the total number of votes cast in said City was
5,248
4. That the names of persons voted for at said election
for a member of the City Council of said City and the number of
votes given to each such person are as follows:

846 ROBERT B. PFESCOTT
ANTHONY J. SKOTNICKI 1.720
5. That the City Council does declare and determine that
ANTHONY J. SKOTNICKI was elected as a member of the City Council
z)f said City for a term ending on March 9, 1976.
6. That the City Clerk shall enter on the records of the
5ty Council of said City a statement of the result of said elec-
tion showing:
(a)
(b) The names of the persons voted for.
(c)
(d)
The whole number of votes cast in the City.
The office which each person was voted for.
The number of votes given in the City to each
?erson.
7. That the City Clerk shall immediately make and, upon
:ompliance by the person elected with the provisions of Sections
L1550 and 11559 of the Elections Code of the State of California,
;hall deliver to the person elected a Certificate of Election
signed by the City Clerk and duly authenticated; that the City
Xerk shall also administer the Oath of Office prescribed in the
State Constitution of the State of California and shall have the
ierson subscribe thereto and file the same in the office of the
City Clerk.

8. That the City Clerk shall certify to the passage and
a.doption of this resolution, shall enter the same in the book of
original resolutions of said City, and shall make a minute of the
passage and adoption thereof in the records of the proceedings of
the City Council of said City in the minutes of the meeting at
which the same is passed and adopted.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Zarlsbad City Council held on the 16th day of July , 1974,
by the following vote, to wit:
AYES: Councilmen Frazee, Chase, McComas, and Lewis.
NOES: None.
ABSENT : None.
