RESOLUTION NO. 3481
A RESOLUTION OF THE CITY COUNCIL OF THE
A MEMORANDUM OF UNDERSTANDING BETWEEN
REPRESENTATIVES OF MANAGEMENT AND THE
CARLSBAD MISCELLANEOUS EMPLOYEES.
CITY OF CARLSBAD, CALIFORNIA, ACCEPTING
WHEREAS, representatives of Management and the Carlsbad
Miscellaneous Employees have been conducting negotiations pursuant
to the Meyers-Milias-Brown Act regarding wages and other terms
and conditions of employment for the 1974-75 fiscal year; and
WHEREAS, said representatives have reached agreement which
they desire to submit to the City Council for approval: and
WHEREAS, the City Council has determined it to be in the
public interest to accept such an agreement in the form of a
Memorandum of Understanding marked Exhibit A and incorporated by
reference herein;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the Memorandum of Understanding between the
Carlsbad Miscellaneous Employees and representatives of Management
is hereby accepted.
3. That the City Council intends to implement said Memo-
randum by incorporating its terms into the salary plan for fiscal
year 1974-75 and the personnel rules of the City of Carlsbad and
by other appropriate actions as necessary in accord with its terms.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 6th day of August , 1974,

EXHIBIT A
MEMORANDUM OF UNDERSTANDING BETWEEN
MANAGEMENT REPRESENTATIVES OF THE CITY
OF CARLSBAD AND THE CARLSBAD POLICE
OFFICERS ASSOCIATION FOR FISCAL YEAR
1974-1975
WHEREAS, the City of Carlsbad Police Officers
Association has been negotiating as part of the meet and
confer process with representatives from Management regard-
ing wages and certain other terms and conditions of employ-
ment to be effective for fiscal year 1974-1975; and
WHEREAS, the parties to said negotiation have
reached agreement and wish to present this Memorandum of
Understanding incorporating all the terms of that agreement
to the City Council and request that it be approved and
implemented;
NOW, THEREFORE, IT IS AGREED by and between the
Management representatives (City) and the Carlsbad Police
Officers Association (Association) that the following terms
and conditions of employment for fiscal year 1974-1975 be
submitted to the City Council:
1. PERSONNEL INCLUDED
This agreement shall apply to the following employees
in the Carlsbad Police Department:
A. Police Captain
B. Police Lieutenant
C. Police Sergeants
D. Police Officers
E. Secretary to the Police Chief
F. Communicators
G. Community Service Officer-Coordinator
2. SALARY ADJUSTMENT
The City shall provide a 9% salary increase for all
ranges and steps for all included personnel effective as of
July 1, 1974.
3. EDUCATIONAL INCENTIVE PAY ADJUSTMENT
City and Association agree to an amendment to
Personnel Rule XV to decrease the maximum possible compen-
sation under the Education Incentive Program from 12-1/2%
to 10%. The Compensation schedule will be amended accord-
ingly to reflect the 10% maximum on seven or more years'
service with ninety or more POST points or college units
in accredited courses toward a BS or BA in an appropriate
field. The balance of the schedule will remain the same.
4. CONTINGENCY CLAUSE
It is understood and City agrees that if either
of the other City employee groups receives a pay increase
of more than 9%, included personnel will also receive the
same rate of increase; and further, if either of the other
groups is not required to give up the top 2-1/2% of its
education incentive program to receive a 9% increase,
included personnel would likewise not be required to relin-
quish its top 2-1/2%.
5. SHOOTING PAY ADJUSTMENT
City and Association agree to an amendment to
Personnel Rule IV, Section 8, to decrease shooting pay by
the elimination of the currently effective table of compen-
sation for pistol marksmanship applicable to all sworn per-
sonnel within the Association and to replace it with a
schedule providing that shooting pay in the amount of $50.00
per year payable on the first regular pay day in December
will be granted to all sworn personnel qualifying as Expert
in any six months during said year.

6. HOLIDAY ADJUSTMENT
City and Association agree to an amendment to
Personnel Rule X, Section 13 to delete Admission Day from the
list of City holidays and to include in lieu thereof for all
included personnel each employee's birthday as an individual
holiday to be celebrated by that employee only. If an
employee's birthday shall fall on a Saturday, Sunday or
other holiday, an appropriate alternate day shall be selected
as the holiday by the employee with the approval of the
Police Chief.
7. RETIREMENT
City agrees to amend the contract with the Public
Employees Retirement System for all sworn personnel who
qualify as local safety membeks $of the System to provide
at City's cost for the extension of retirement benefits in
certain circumstances to the members' survivors 'as provided
in Section 21263 of the California Government Code.
8. CONTINUANCE OF TERMS
All other terms and conditions of employment
applicable to included personnel and not inconsistent with
the terms of this Memorandum of Understanding shall remain
in effect.
