HomeMy WebLinkAbout1974-11-19; City Council; Resolution 35471 2 3 4 5 6 7 8 9 1c 11 12 1: 14 9 >o t 2c 21 22 2; 24 2: 2t 2; 2t 2E 3( 31 3: 0 RESOLUTION NO. 3547 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING TENTATIVE MAP (CT 73-2) FOR 179 SINGLE- FAMILY LOTS, 3 CONDOMINIUM LOTS WITH A MAXIMUM DENSITY OF 20 DWELLING UNITS PER ACRE AND 8 OPEN SPACE LOTS ON 57.3 ACRES LOCATED SOUTHWESTERGY OF THE INTERSECTION OF LA COSTA AVENUE AND RANCHO SANTA FE ROAD. APPLICANT: LA COSTA LAND COMPANY WHEREAS, on October 8, 1974, the Carlsbad City Plann-ng Commission adopted Resolution No. 1103 recommending to the City Council that Tentative Map (CT 73-2) be approved; and WHEREAS, the City Council of the City of Carlsbad, on the 6th day of November , 1974, considered the recommendation of the Planning Commission; and WHEREAS, an Environmental Impact Report has been prepared and discussed at duly noticed public hearings before the Planning Commission and the City Council, and the final report has been certified as complete in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-2) is hereby approved subjec to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. The final map shall be submitted for approval with in one year from the final action by the City Council on the Tentative Subdivision Map. The final map shall be in substantial conformance of the Tentative Subdivision Map known as Exhibit A, dated October 10, 1974. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements limitations and restrictions of all municipal ordinance and state and federal statutes now in forced or which hereafter may be in force for the purpose of preserving the residential characteristics of adjacent properties. 3. All public improvements shall be made in conform- ity to the City of Carlsbad Engineering Design Criteria 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 and Standard Plans, the Subdivision Ordinance and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free from all liens and encumbrances. Improvement plans for water and sewer systems shall meet the requirements of the respec- tive service districts. 4. All land and/or easements required by this ordi- nance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. 5. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. 6. All drainage and flood control facilities shall be approved by the County of San Diego Flood Control District prior to installation. 7. Ornamental street lighting shall be provided for as required by Municipal Code. The developer shall post a bond and/or cash in the amount necessary to energize said lights for an 18-month period after construction to permit the incorporation of the subdivision into a main- tenance district. This shall be done prior to approval of final map. a geological investigation and a complete grading plan of the entire site when required by the City Engineer. The report and plan shall be prepared by civil engineers licensed by the State of California and experienced in erosion control. Said engineers shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties. 8. Street trees, when required by the City, shall be installed by the applicant at his expense. Trees shall be of a type approved by the Parks Department and shall be installed to their specifications. If removal of any existing trees is required by the City, said removal shall be at the applicant's expense. It shall be the respon- sibility of the applicant to make all arrangements with the Parks Department concerning the requirements of this .condition. These arrangements are to be made prior to approval of the final map. 15. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to approval of the final map. 16. The CC&R's for this development shall be submit- ted to the Planning Director for review and approval prior to the approval of final map. 17. An Open Space easement shall be dedicated to the City over Lots 183 through 190, inclusive, as shown on the Tentative Map, prior to approval of the final map. 18. A forty-foot open space easement along the south- erly boundary of the subdivision shall be offered for dedication to the City by separate instrument prior to approval of the final map. 19. Prior to the issuance of grading permits devel- oper shall cause the San Diego Museum of Man or other recognized archeological organization to conduct a survey of the subject property to determine if there are addi- tional steps necessary to preserve the archeological resources of the site. A letter from such an organization stating that this condition has been met shall be submit- ted to the City Engineer. A report from such an organi- zation which sets forth a program shall be submitted to the Planning Commission for approval. The Planning Com- mission may consider recommending the imposition of addi- tional conditions deemed necessary in view of the arche- ological report. Upon receipt of such recommendations the City Council may impose any additional conditions which may be necessary in view of the report which shall be satisfied prior to approval of the final map. 20. The applicant shall dedicate and make offsite improvements to City standards (28-foot section) on Segovia Way, from its intersection with Levante Street to the project boundary. 21. Bicycle provisions on Rancho Santa Fe Road are to be established in accordance with standards satisfactor to the City Engineer. C. That said Tentative Map, together with the provisions for its design and improvement and subject to the above conditions is consistent with all applicable general and specific plans of the City of Carlsbad. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 19th day of November, 1974, by the following vote, to wit: AYES: Councilmen Frazee, Chase, Lewis, McComas and Skotnick.
