The City Council of the City of Carlsbad, California does hereby resolve as follows: 1. That that certain agreement between the City of Carlsbad and North County Lifeline for services in the City's drug abuse prevention program, a copy of which is attached hereto as Exhibit A and incorporated herein by reference, is hereby approved 2. That the Mayor of the City of Carlsbad is hereby author- ized and directed to execute said agreement forandon behalf of the City of Carlsbad. PASSED, APPROVED AND ADOPTED at a regular meeting of the City day Council of the City of Carlsbad, California, held on the 19th of August , 1975, by the following vote, to wit: AYES: Councilmen Frazee, Chase, Lewis, Skotnicki and Councilwot2an NOES: None ABSENT : Pi 0 n e ATTEST Casler AGR%EMENT FOR DRUG ABUSE SERVICES TEIS AGREExENT erttered into as of December 7 1976 , by and ba,tween the CITY OF CARLSBAD, 2 municipal corporation of the State of California, hereafter referred to as "City", and NOXTH COUNTY LIFELINE, a community organization, hereafter referred to as "Contractor"; WITNESSETH: FTHEREAS, the City is engaged in programs to remedy and prevent drug abuse problems; and WHEREAS, Contractor is experienced in performing certain services for persons seeking help for drug and drug related problems ; and WHEREAS, City desires to employ an independent contractor to perform the hereinafter described services in connection with City's drug abuse program; _._ NOW, THEREFORE, IT IS AGREED as follows: 1. The City hereby agrees to employ Contractor, and Contractor hereby agrees to perform the following services, connection with the City's drug abuse program: in (a) Employment of the following personnel to staff the drug abuse program: (i) Part-time group leaders drawn from graduates in the behavioral sciences to meet with groups and serve as counselors; (ii) Clerical aide to develop promotional material, keep records and assist in compiling material for evaluation; EXHIBIT A to Resolution No. 4036 f (iii) Proyrarn zoordimtor who will develop and coordinate grcups, recruit and aid in trairizg acd supervision of part- time qroup leaders; and establish an evaluative process I (b) Direct the program to the stated objectives, motivate drug users to withdraw from use and seek assistance, prevent drug abuse by potential users, and increase the knowledge on the part of all group participants of the nature and danger of drugs. (c) Provide counsel sessions for either drug abusers or potential users of drugs to give them an oppor- tunity to receive help in terms of personal problems that bring them to the use of drugs, provide them information about the nature of drugs and provide knowledgeable advice about other community resources where assistance is available and needed. (d) Provide such services to persons referred by the City schools, and to participants in the Youth Lifeline program: generally to be limited to high school age groups and young adults under twenty-five. (e) Participate as requested in the City's total evalu- ation of the effectiveness of drug abuse agencies in meeting the needs related to drug abuse. (f) Submit a written report semi-annually to the City Manager and City Council stating the progress toward -2- .. the stated goals of the prograx as listed above, or any change in emphasis. 2. The term of this Agreement is twelve months, comvzncing July 1, 1976, and ending June 30, 1977. 3. In consideration of the services provided herein, City shall pay to Contractor ths sum of One Thoustznc! Dollars ($S,OOO.OO). Said sum shall be paid in equal semi-annual installments after receipt of a written clain frorn Contractor and the written report specified in Section 1 (f) of this Agreement. 4. Contractor shall procure and maintain a policy or policies of public liability and property damage insurance with an insurance company or companies approved by the City Manager, wherein City is named as an insured; such insurance to insure, to a limit of not less than $300,000.00 for injuries or death of any one person and $500,000.00 with respect to any one incident or occurrence and to a limit of not less than $100,000.00 for property damage, City against any and all claims, demands, obligations, liabilities, cause or causes of action by reason of any act or omission by or on behalf of Contractor, its members, agents, employees, permittees, or invitees, whether negligent, intentional or otherwise arising out of or in any way connected to this Agreement or the performance thereof. 5. The City Manager, or his designated representative, shall represent the City in all matters pertaining to services rendered pursuant to this Agreement and shall administer this Agreement on behalf of the City. The Director of North County Lifeline shall be in charge of performance and administer this Agreement on behalf of Contractor. -3- 5. Said Contractor shall perform the services provided for herein in its own way as an independent contractor and in the pursuit of its independent calling, and not as an employee of the City; and it shall be under the control of City only as to result to be accomplished, and not as to the means or manner by which such result is to be accomplished, IN WITNESS WHEREOF, the parties have caused this Agreernent to be executed the date first above written.
