RESOLUTION NO. 3737
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE (ZC-159) FROM R-1-10 TO C-2-Q AND
R-P-Q ON PROPERTY LOCATED ON THE SOUTHEAST
CORNER OF EL CAMINO RJ3AL AND MARRON ROAD
ALIGNMENT. APPLICANT: CITY INITIATED
(RINKER PROPERTIES)
WHEREAS, on July 9, 1975, a duly advertised public hearing
Mas held before the Planning Commission in the manner prescribed
3y law to consider a change of zone from R-1-10 to C-2-Q and
R-P-Q on property described as follows:
Being a portion of Lot 4 and 5 in Section 32, Township
11 South, Range 4 West, San Bernardino Meridian, in
the City of Carlsbad.
WHEREAS, at the conclusion of said hearing the Planning
Jommission of the City of Carlsbad adopted Resolution No. 1170
recommending said zone change which is herewith referred to and
nade a part hereof: and
WHEREAS, on August 19, 1975, the City Council held a
?ublic hearing on the matter, received all recommendations and
neard all persons interested in or opposed to the proposed change
3f zone; and
WHEREAS, an Environmental Impact Report was certified as
zomplete for a previously issued entitlement for this project, and
the Planning Director has found Zone Change (ZC-159) to be in
?rior compliance with the City of Carlsbad Environmental Protection
3rdinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the

City of Carlsbad as follows:
1.

That the above recitations are true and correct.
That the findings of the Planning Commission contained
in the aforementioned Resolution No. 1170 constitute the findings
of the Carlsbad City Council.
3. That the approval of the proposed change of zone
classification is necessary to carry out the general purpose of
Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a meeting of the City
Council on the 2nd day of September , 1975, by the following
vote, to wit:

Councilmen Frazee, Lewis, Skotnicki and Councilwoman Casler
