RESOLUTION NO. 3822
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS
AND DECISION REGARDING CHANGE OF ZONE (ZC-154)
FROM L-C (LIMITED CONTROL) to P-U (PUBLIC
UTILITIES) FOR DEVELOPMENT OF A PIPELINE
BOOSTER PUMP STATION ON PROPERTY LOCATED
ON THE NORTHEAST CORNER OF THE INTERSECTION
OF EL CAMINO REAL AND OLIVENHAIN ROAD.
APPLICANT: SAN DIEGO PIPELINE.
WHEREAS, on November 26, 1975, a duly advertised public
hearing was held before the Planning Commission in the manner
prescribed by law to consider a change of zone from L-C (Limited
Control) to P-U (Public Utilities) on property described as
follows:
That portion of Lot 8 in section 2, township 13 south,
range 4 west, San Bernardino meridian, in the County
of San Diego, State of California, according to
official plat thereof, lying westerly of the westerly
line of the Rancho Encinitas and lying easterly of
the easterly line of the 90 footkrip of land
described in parcel 67083-A in said deed to the
County of San Diego, recorded November 28, 1969,
as document No. 217326 of official records and lying
northerly of the northerly line of that certain 60 foot strip described in parcel 61294-B in deed to
the County of San Diego recorded September 28, 1961,
as document No. 169289 of official records known as
road survey No. 16.31;
to allow construction of a pipeline booster pump station on
property located on the northeast corner of the intersection of
El Camino Real and Olivenhain Road, as shown on map marked ZC-154
Exhibit 1, dated November 17, 1975; and
WHEREAS, at the conclusion of said hearing the Planning
Commission of the City of Carlsbad adopted Resolution No. 1207
recommending said zone change which is herewith referred to and
made a part hereof; and

WHEREAS, on December 16, 1975, the City Council held a
public hearing on the matter, received all recommendations and
heard all persons interested in or opposed to the proposed change
of zone; and
WHEREAS, the Planning Director has determined that said
change of zone will have a nonsignificant impact on the environ-
ment, and a Negative Declaration has been prepared and filed
in satisfaction of the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1972 and the California
Environmental Quality Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission containec
in the aforementioned Resolution No. 1207 constitute the findings
of the Carlsbad City Council.
3. That the approval of the proposed change of zone
classification is necessary to carry out the general purpose of
Title 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
to adopt an ordinance to effectuate the proposed change of zone.

following vote, to wit:
