A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CON- DITIONS TENTATIVE MAP (CT 76-4) FOR A 140 LOT SUBDIVISION ON PROPERTY GENERALLY LOCATED 'WEST OF PASEO DEL NORTE, NORTH OF CAMINO DE LAS ONDAS, EAST OF CAMINITO DEL PRADO AND SOUTH OF CAMINITO ESTRADA. APPLICANT: WES MUDGE (AGENT: PACIFIC SCENE, INC. ) .
S, on May 12, 1976, the Carlsbad City Planning
Commission adopted Resolution No. 1251 recommending to the City
Council that Tentative Map (CT 76-4) be conditionally approved:
and
WHEREAS, the City Council of the City of Carlsbad, on June 1,
1976, considered the recommendation of the Planning Commission;
and
WHEREAS, said Tentative Map has been declared to have a
nonsignificant impact on the environment and a Negative Declara-
tion has been prepared and filed in compliance with the require-
ments of the City of Carlsbad Environmental Protection Ordinance
of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That said Tentative Map, together with the provisions
for its design and improvement and subject to the conditions of
this resolution, is consistent with all applicable general and
specific plans of the City of Carlsbad.
C. That the findings of the Planning Commission, in
Resolution No. 1251, constitute the findings of the City Council

in this matter.
D. That Tentative Map (CT 76-4) is hereby approved subject
to all applicable requirements of the Carlsbad Municipal Code and
to the satisfaction of the following conditions:

The approval is granted for the land described in the application and attachments thereto, and as shown on the
plot plan submitted, labeled Exhibit "D", dated May 3,
1976, except as indicated herein. The final map shall
be submitted for approval within 18-months from the
date of final action by the City Council. The final map
shall be in substantial conformance with the tentative
map, Exhibit I'D".
Street names shall be designated in accordance with
City Council Policy 20 and shall be approved by the Planning Director prior to approval of the final map.
All dwelling unit garages will be supplied with automatic
garage door openers.
All dwelling unit garages, when closed, shall be set
back from the interior edge of the sidewalk according
to the following dimensions:
a) Minimum 3-feet, maximum 7-feet; or
b) 20-feet or more.
Parking will be restricted through CC&R's, red curbs, and signing along the side of the street accommodating dwelling units.
If requested by the City Engineer, an amended tentative
map shall be submitted for approval by the City Engineer prior to review of the final map to assure compliance
to all conditions of approval.
In order to provide for reasonable fire protection during
the construction period, the subdivider shall maintain
passable vehicular access to all buildings and adequate
fire hydrants with required fire flows shall be installed as recommended by the Fire Department.
Ornamental street lighting shall be provided for as required by Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an 18-month period after construction

to permit the incorporation of the subdivision into a
maintenance district.
9. All land and/or easements required shall be granted to the City of Carlsbad without cost to the City, and free
of all liens and encumbrances. No easements shall be
recorded prior to recordation of the final map unless
approved by the City Engineer.
10. All public improvements shall be made in conformity with
the City of Carlsbad standards, the Subdivision Ordinance and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad and free of all liens and encumbrances. Improvement plans for
water system shall meet the requirements of that service district.
11. Applicant shall dedicate and improve "A" Street to City
of Carlsbad standards on the basis of a 54-foot street
section with a 34-foot curb-to-curb dimension according
to its alignment on the tentative map.
12. Applicant shall dedicate and guarantee the extension of
Camino de las Ondas northerly and easterly of Paseo del
Norte within the subdivision boundary on the basis of
a 34-foot half street section with a 10-foot parkway
to the City of Carlsbad standards.
13. Prior to recordation of the final map, the applicant
or his successor in interest shall enter into a secured
agreement guaranteeing payment of 1/4 of the cost of
a future traffic signal at the intersection of Paseo del
Norte and Camino de las Ondas prior to recordation of
the final map.
14. The design of private streets shall conform to the
tentative map, and shall be approved by the City Engineer.
Private street construction shall be inspected and
approved by the Public Works Inspector. Standard plan checking and inspection fees shall be paid.
15. Private streets shall have vertical curbs, shall have
markings prohibiting parking on the garage sides, and
shall have a change of paving at all intersections with
public streets to delineate street type boundary.
16. The ends of the cul-de-sac turnarounds adjacent to
Camino de las Ondas shall be free of obstructions such
as: fire hydrants, street trees, street lights or
similar appurtenances that would block emergency access.
17. Direct access rights to Paseo del Norte and Camino de las Ondas shall be waived on the final map, except at private

street entrances shown on the tentative map.
18, CC&R's for this subdivision shall be submitted to the Planning Director for his approval prior to final map approval. The CC&R's shall contain a statement that the Encina Water Pollution Control facility (sewer plant) serving the cities of Carlsbad and Vista and various special districts, is located on the west side of 1-5
upwind from this development.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
sbad City Council held on the 15th day of June 1
376 by the following vote, to wit:
