RESOLUTION NO. 3942
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS
AN EXTENSION OF TENTATIVE MAP CT 74-14.
WHEREAS THE CITY COUNCIL of the City of Carlsbad, on the
.7th day of January, 1975, adopted Resolution No. 3565 approving
rith conditions tentative map CT 74-14, subject to its annexation
.o the City; and
WHEREAS, said annexation was certified August 21, 1975, and
WHEREAS, the subdivider has requested a one year extension
)f such map from August 21, 1976, to August 21, 1977, and
WHEREAS, the City Council has determined to extend such
lap subject to additional conditions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
5ty of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That tentative map CT 74-14 is hereby extended, subject
.o the execution and/or fulfillment of all the conditions of Reso-
.ution No. 3565 and the following conditions:
1. Prior to any occupancy of any portion of the Specific
'lan area the applicant shall file with the Clerk of the City of
:arlsbad a petition for the formation of an Open Space Maintenance
Iistrict as provided for in Section 50590 of the California State
;overnment Code. The applicant shall maintain all landscaping in-
italled in conformance with this plan until such time as an Open
Space Maintenance District is established and accepts maintenance
responsibilities as prescribed in the Open Space Maintenance Act,
>r until maintenance responsibility is accepted by another entity
icceptable to the City. Should the City Council not approve such
3 Maintenance District, the applicant shall form a Homeowner's
!issociation. The CC&R's for the Association shall contain provi-
sions guaranteeing maintenance of said landscaping and shall be
reviewed by the Planning Director.

2. Improvement plans shall show adequate provision for a
Looped water system. The des gn shall meet the requirements of the
?ire Department and City Engineer.
C. That said tentative map extension, together with pro-
Jisions for its design and improvement and subject to the above
zonditions, is consistent with all applicable general and specific
2lans of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
3arlsbad City Council held on the 6th day of July I
L976 with the following vote, to wit:
AYES : Councilmen Frazee, Lewis, Packard, Skotnicki and
NOES : None
ABSENT : None
