HomeMy WebLinkAbout1976-09-07; City Council; Resolution 3998RESOLUTION NO. 3998 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 76-7) .FOR A 45 LOT SUBDIVISION ON A 15 ACRE PARCEL GENERALLY LOCATED ON THE WEST :SIDE OF EL CAMINO REAL BETWEEN ALGA :ROAD AND ARENAL ROAD. APPLICANT: JACK GLEASON (NEWPORT SHORES BUIILDERS) WHEREAS, on July 28, 1976, the Carlsbad City Planning Commission adopted Resolution No. 1265 recommending to the City Council that Tentative Map (CT 76-7) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on August 17, 1976, considered the recommendation of the Planning Commission; and WHEREAS, an Environmental Impact Report was certified as complete for a previously issued entitlement for this project, and the Planning Director has found the Tentative Map (CT 76-7) to be in prior compliance with the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsibad as follows: A. That the above recitations are true and correct. B. ?'hat said Tentative Map, together with the provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. That Tentative Map (CT 76-7) is hereby approved subject to a11 applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. 2. 3. 4. 5. 6. 7. 8. The approval is granted for a portion of the land described in the application and any attachments thereto, and as shown on the plot plan submitted, labeled Exhibit "A", dated May 25, 1976, as modified by staff to show Phase 5 boundaries only. The Final Map shall be submitted within 18 months from the date of final approval by the City Council of the Tentative Subdivision Map, Final Map being in conformance with Tentative Subdivision Map, Exhibit "A". The applicant shall insure adequate noise attenuations for all portions of the site subject to ambient noise levels in excess of 65 dB(A). This shall be accom- plished in a manner acceptable to the Planning Director and according to the policies and goals of the Noise Element of the General Plan. Additional right-of-way shall be dedicated and street improvements made to provide a standard 126 foot street section with separate bikeway for El Camino Real, from Alga Road to Arenal Road. Arenal Road shall be dedicated and improved on the basis of a full 84 foot street section with separate bikeway, in conformance with the Circulation Element of the General Plan. Improvements shall be constructed from El Camino Real to the rear lot line of the lot on the west side of the Street 'IC" intersection. Dedica- tion shall be for entire Alga Road within the sub- division boundary, and applicant shall provide offsite street right-of-way where the street overlaps the south boundary of the subdivision. A four-way, fully actuated traffic signal with left turn pockets shall be installed at the intersection of Alga Road and El Camino Real. City will attempt to secure reimbursement for the developer by agreements wich the surrounding or abutting developers. Dedication of Arenal Road shall include a waiver of direct access rights from all lots shown on the final map as abutting thereon. Two 15 foot wide public easements for pedestrian/ equestrian use shall be dedicated between the most westerly north-south street and the 150 foot SDG&E ea $5 emen t . Street trees should be selected by the Parks and Recreation Department, in conjunction with the land- scape architect, on all streets. 10. Landscape and irrigation plans shall be submitted for approval by the Director of Parks and Recreation. 11. H:ydroseed mix will be approved by the Parks and Recreation Department and also proof of plant specie and quality of seed shall be submitted for approval. 12. All banks hydroseeded shall have a soil analysis taken no closer than 500 feet or farther than 1,000 feet apart and said analysis will show a minimum of nitrogen phosphorus and potassium, E.C., Ph., and organic composition. 13. Park fees in lieu of land shall be paid to the City of Carlsbad for park purposes as required by the Subdivis- icm Ordinance and Parks and Recreation Element prior tcl the approval of each Final Map. In the event private recreation facilities are provided by the applicant, a maximum of 25% credit may be granted by City Council against the total Park Ordinance requirement. 14. The applicant shall dedicate an open space easement along the bank at the rear of lots backing up to El Camino Real. 15. All areas of the subdivision shall be designated as a legal lot or public right-of-way. 16. The method of storm drainage shown on the map is not approved. Storm drainage shall be designed per the requirements of the City Engineer and San Diego County Flood Control District. 17. All drainage easements shall be improved by a culvert or drainage channel of adequate size, whichever is required by the San Diego County Department of Sanitation and Flood Control. Where a drainage channel is required, such channel shall be lined with a suitable material as specified by the County Department of Sanitation and Flood Control. An access easement shall be provided to each drainage system maintenance access point not directly accessible from a public roadway, said access easement shall be paved and aligne to the satisfaction of the County Department of Sanitation and Flood Control and the City Engineer. 18. A desilting basin, within an adequate easement, and designed to the satisfaction of the County Department of Sanitation and Flood Control will be required at the outlet of the major drainage facility. 20. In order to provide for reasonable fire protection dur- ing the construction period, the subdivider shall main- tain passable vehicular access to all buildings, and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 21. All public improvements shall be made in conformity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards to the satisfaction of the City Engineer without cost to the City of Carlsbad, and free of all liens and encumbrances. All improvement plans for water and sewer system shall meet the requirements of the respective service districts. 22. All drainage and grading plans shall be submitted to the City Enqineer for approval. 23. All utilities, including provisions for cable TV, shall be placed underground and/or shall be completely concealed from view. 24. A1:L land and/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City and free of all liens and encumbrances. 25. The covered archway and planter strip on Arena1 Road is not approved. 26. Street names shall be designated in accordance with the adapted City street name policy and shall be approved by the Planning Director prior to Final Map approval. 27. If required by the City Engineer, the imporvement plans shz.11 include a report of a geological investigations andl a complete grading plan of the entire site. The reFort and plan shall be prepared by civil engineers licensed by the State of California, and experienced in erosion control who shall be acceptable to the City Engineer, and they shall certify they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties. 28. The development of the property described herein shall be subject to the restrictions and limitations set 4. 12 a 19 20 21 22 23 24 25 26 27 28 forth herein which are in addition to all the require- ments, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, ox: which, hereafter, may be in force, for the purpose of preserving the residential characteristics of adjacent properties. 29. Prior to consideration of each Final Map and Improve- ment Plan, a grading and plot plan of the tract with al.1 proposed dwelling units located thereon, and show- ing appropriate setback dimensions, shall be submitted tc, the Planning Department for approval to insure that adequate area requirements can be met. 30. Al.1 land and/or easements required shall be granted to tke City of Carlsbad without cost to the City, and free of' all liens and encumbrances. No easements shall be remcorded prior to recordation of each Final Map unless approved by the City Engineer. 31. Pkase 5 will be developed in numerical order with Phase 1-5 of the Rancho La Cuesta Subdivision as shown on C'I 72-34 and CT 76-7.
