RESOLUTION NO. 4031
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, GRANTING
AN APPEAL AND APPROVING CONDITIONAL USE
PERMIT (CUP 86A), FOR A TEMPORARY OFFICE
BUILDING LOCATED AT 2965 ROOSEVELT STREET.
APPLICANT : JAMES M. GAISER.
WHEREAS, the Planning Commission of the City of Carlsbad
did on May 12, 1976 hold a duly noticed public hearing to consider
the application of James M. Gaiser for a Conditional Use Permit
(CUP 86A), to allow the continued use of a temporary mobile office
located at 2965 Roosevelt Street; and
WHEREAS, the subject application is in compliance with the
City of Carlsbad Environmental Protection Ordinance of 1972 in
that is has been determined that it does not involve significant
environmental effects and a negative declaration has been prepared
and filed; and
WHEREAS, at the conclusion of said hearings the Planning
Commission, after making certain findings, denied the permit; and
WHEREAS, the applicant filed an appeal with the City Council
of the determination of the Planning Commission seeking relief
from said denial; and
WHEREAS, the City Council at their meeting of July 6, 1976
held a public hearing to consider the appeal and after hearing,and
considering all testimony, reports and communications,returned the
matter to the Planning Commission for report. Said report has
been received and the City Council has, at their meeting of
October 26, 1976, considered the matter further;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:

That the above recitations are true and correct.
That the appeal of Mr. James M. Gaiser of the Planning
Commission's denial of Conditional Use Permit (CUP 86A)is hereby
granted.
3. That Conditional Use Permit (CUP 86A) for use of a
mobile office as a temporary office facility at 2965 Roosevelt
Street is hereby approved for a period expiring on January 6, 1977
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the 16th day of November , 1976, by the
following vote, to wit:
