RESOLUTI'ON NO. 4072
A RESOLUTION OF 'THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS 'TENTATIVE MAP (CT 75-9)
FOR A 211-LOT SUBDIVISION ON PROPERTY
GENERALLY LOCATE'D ON THE EAST SIDE OF
RANCHO SANTA FE ROAD BETWEEN LA COSTA
AVENUE EXTENSION AND OLIVENHAIN ROAD.
APPLICANT: LA COSTA LAND COMPANY.
WHEREAS, on November 22, 1976, the Carlsbad City Planning
Commission adopted Resolution No. 1297 recommending to the City
Council that Tentative Map (CT '75-9) be conditionally approved;
and
WHEREAS, the City Counc.il of the City of Carlsbad, on
December 21, 1976, considered the recommendation of the Planning
Commission; and
WHEREAS, an Environmental Impact Report was certified
as complete for a previously issued entitlement for this project,
and the Planning Director has found the Tentative Map (CT 75-9)
to be in prior compliance with -the City of Carlsbad Environmental
Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That said Tentative Map, together with the provisior
for its design and improvement and subject to the conditions of
this resolution, is consistent with all applicable general and
specific plans of the City of Carlsbad.
C. That the findings of the Planning Commission in
Resolution No. 1297 constitute the findings of the City Council
in this matter.

D. That Tentative Map (CT 75-9) is hereby approved
subject to all applicable requi:rements of the Carlsbad Municipal
Code and to

the satisfaction of the following conditions:
The approval is granted for the land described in the
application and attachments thereto, and as shown on
the plot plan submitted, labeled Exhibit "A", dated
November 16, 1976, except as indicated herein. The final map shall be submitted for approval within
eighteen months from the date of final action by the
City Council, and shall be in substantial conformance
with the tentative subdivision map, Exhibit "A".
Street names shall be designated in accordance with City Council Policy 20 and shall be approved by the Planning Director prior to approval of the final map.
Concurrent with final map approval, the applicant
shall grant an open space easement for maintenance
and improvement purposes over those portions of those lots described in Condition 5 below.
Prior to the issuance of grading permits, the City Engineer shall approve a plan submitted by the
applicant for interim erosion control on all man-made
slopes in excess of five feet created by this sub-
division. Prior to this issuance of grading permits,
the applicant shall.. post bonds and agreements ensuring
the installation arid maintenance of the erosion contro
system until permanent landscaping is installed and
maintained.
Prior to the issuance of any building permits, the
applicant shall submit a permanent landscaping and irrigation plan to the Parks and Recreation Director
for his approval. The plan shall:
(a) Cover those sl.opes in excess of five feet in height at the rear and the sides of lots where
the toe of such slopes is adjacent to public
rights-of-way.
(b) Utilize fire-retardant, drought-resistant land-
scaping which includes trees and shrubs which
reach a variet.y of sizes at maturity; and
(c) Utilize an irrigation system appropriate for
maintenance of the required landscaping in
conformance with Conditions 6, 7 and 8.
Permanent landscaping and irrigation shall be installe
on all lots identified in Condition 5(a) before any
of those lots are cccupied. If residential construc-

tion occurs in units, this condition shall be met
on a unit-by-unit basis.
Prior to the issuance of building permits, the pro-
vision of permanent open space maintenance on those
areas as indicated in Condition 5 shall be assured in
a manner acceptable to the City Council.
Vegetation clearing operations shall be made no more
than two weeks in advance of grading.
No grading shall occur during the months of January
through March, except when special measures can be
taken to control siltation. This condition shall be met to the satisfaction of the City Engineer.
All graded surfaces shall be watered and rolled to
form a compacted c.ap of soil.
Concurrent with final map recordation the applicant
shall dedicate Are'a "A" to the City of Carlsbad as
shown on Exhibit "A" dated November 16, 1976 for
park purposes. The park site so dedicated shall be
12.5+ acres in size, and its precise boundaries
approved by the City Council prior to final map approT
al.
The water system shall be looped from Rancho Santa Fe
Road, to Mission Estancia, to La Costa Avenue; and
back to Rancho Santa Fe Road.
The water system serving lots 1-30, as shown on
Exhibit "A" dated November 16, 1976, shall be looped
from "A" Street to "B" Street to Mission Estancia.
All drainage easements shall be improved by a culvert
or drainage channe:l of adequate size, whichever is
required by the San Diego County Department of
Sanitation and Flood Control.

Mission Estancia shall be improved on the basis of a
a twenty-eight foot street section from Rancho Santa
Fe Road to the intersection with "A" Street. Mission
Estancia shall be improved on the basis of a forty-
two foot half street section from the intersection
with "A" Street to the intersection with proposed
La Costa Avenue.
Improvements shall be as shown on the tentative map,
except that street lights shall be included according
to City of Carlsbad standards and all slopes adjacent
to the Street shall be 2:l maximum.
The applicant shall enter into a secured agreement
for improvement of the northerly half of Mission
Estancia along the proposed Stagecoach Park site
frontage, to City of Carlsbad standards.
La Costa Avenue right-of-way, including slope ease- ments, shall be dedicated and La Costa Avenue shall
be graded on the basis of an eighty-four foot street
section and improved on the basis of a forty-two foot
half street section from Rancho Santa Fe Road to the
intersection with proposed Mission Estancia. ments shall be as shown on the tentative map, except
that street lights shall be included according to
City of Carlsbad standards, all slopes adjacent to the
street shall be 2:l maximum, and improvements at the
intersection with Rancho Santa Fe Road shall include
any street transitions to widen or to reduce pavement
width in either street and striping and appurtenances
as may be required for safe vehicular use.

The drainage system is not approved as shown; design
of storm drains, ditches, cross gutters, and other
appurtenances shall be as approved on the improvement plans.
All offsite utility easements necessary to extend utility services to the subdivision, which will be within future public streets, shall be made subordinat to the future public street easement when the street
easement is granted.
Prior to their approval, improvement plans for the
proposed subdivision shall be submitted to the San
Dieguito Unified High School District for its comment to ensure that adequate utility service is available
to the High School site.

30. All man-made slopes occurring on the High School
site as a result of the grading of lots and improve-
ments in the balance of the subdivision shall have
maximum grades of 2.25:1, and shall be contour blended into the existing natural slopes. These man-made
slopes may be increased to a grade of 2.00:l upon approval of the San Dieguito Unified High School
District.
31. The applicant shall install permanent landscaping and irrigation on slopes situated on the High School site,
and shall maintain same until such time as the school
district accepts the dedication of the site or otherwise assumes the maintenance thereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 4th day of January I 1977,
by the following vote, to wit:
