RESOLUTION NO. 5256
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING
FINDINGS AND DECISION REGARDING CHANGE OF
ZONE (ZC-196) FROM C-2 TO C-1-Q ON PROPERTY
GENERALLY LOCATED ON THE SOUTHEAST INTER-
SECTION OF EL CAMINO REAL AND LA COSTA
AVENUE. APPLICANT: CITY OF CARLSBAD.
WHEREAS, on August 24, 1977, a duly advertised public hearinc
ras held before the Planning Commission in the manner prescribed
iy law to consider a change of zone from C-2 to C-2-Q (later modi-
Eied to CF1-Q per Staff Report to Planning Commission dated
September 20, 1977, on file in the Planning Department and
incorporated by reference herein) on property as shown on ,map markec
ZC-196, Exhibit A, attached hereto and made a part hereof; and
WHEREAS, at the conclusion of said hearing the Planning
zoommission of the City of Carlsbad adopted Resolution No. 1400
recommending said zone change; and
WHEREAS, on September 20, 1977 the City Council held a
public hearing on the matter and after receiving all recommendation!
and hearing all persons interested in or opposed to the proposed
change, returned the matter back to the Planning Commission for
further report with the suggestion that consideration be given to
the property being rezoned C-1-Q instead of C-2-Q; and
WHEREAS, upon receipt of said report, wherein the Planning
Commission concurred that the zone should be C-1-Q, the City
Council at their meeting of November I, 1977 considered the matter
further; and
WHEREAS, the Planning Director has determined that said
change of zone will have a nonsignificant impact on the environ-
ment and a Negative Declaration has been prepared and filed in
atisfaction of the requirements of the City of Carlsbad Environ-
iental Quality Act;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
lity of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the findings of the Planning Commission contained
.n the aforementioned Resolution No. 1400 constitute the findings
)f the Carlsbad City Council.
3. That the approval of the proposed change of zone
zlassification is necessary to carry out the general purpose of
'itle 21 of the Municipal Code.
4. That the City Council of the City of Carlsbad intends
20 adopt an ordinance to effectuate the proposed change of zone.
PASSED, APPROVED AND ADOPTED at a meeting of the City
Zouncil on the 15th day of November , 1977, by the following
