RESOLUTION NO. 5257
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE MAP (CT 77-13)
TO PROVIDE FOR 15 CONJX”IUM UNITS ON
.7 ACRES OF PROPERTY GENERALLY LOCATED
ON THE NORTH SIDE OF JUNIPER BETGJEEN
GARFIELD AND THE AT&SF RAILRaOD.
APPLICANT: HARRY FRIES.
WHEREAS, on October 5, 1977 the Carlsbad City Planning
ommission adopted Resolution No. 1408 recommending that Tentative
ap (CT 77-13) be denied; and
WHEREAS, the City Council of the City of Carlsbad on
lovember 1, 1977 considered the recommendations of the Planning
:ommission; and
WHEREAS, said Tentative Map has been declared to be
:ategorically exempt from the provisions of the City of Carlsbad I
Cnvironmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
Jity of Carlsbad as follows:

That the above recitations are true and correct.
That the Planning Commission’s decision to deny
Tentative Subdivision Map (CT 77-13) is hereby denied,
C. That the findings of the City Council are the findings
recommended in the Planning Department Staff Report to the
Departmental Coordinating Committee dated September 28, 1977, I
file in the Planning Department and incorporated by reference
herein.

D. That said Tentative Subdivision Map, together with the
provisions for its design and improvement and subject to the I
conditions of this resolution, is consistent with all applicable

ieneral and specific plans of the City of Carlsbad.
D. That Tentative Subdivision Map (CT 77-13) is hereby
ipproved subject to all applicable requirements of the Carlsbad
lunicipal Code and to the satisfaction of the following conditions:
1. The approval is granted for the land described
in the application and any attachments thereto and as shown on the plot plan submitted, labeled Exhibit A,
dated July 22, 1977, on file in the Planning Deparibment
and incorporated by reference herein.
2. Park-in-lieu fees shall be paid to the City prior to approval of the final map,
3. A recreation and landscape plan is to be approved by the Parks and Recreation Director that includes
recreational uses such as picnic tables, usable open
areas and some form of active recreation facilities.
This recreation area and landscaping shall be fully
installed prior to approval of the occupancy of the units.
4. The uncovered parking area shall be separated
from the abutting property to the west by a 6 ft. view-
obsuring wall, fence, or compact evergreen hedge,
six feet in height.

units, whichever comes first.
5. The maximum number of condominiums as approved is 15 and shall be so indicated on the final map.

City Council of the City of Carlsbad on the
