RESOLUTION NO. 5346
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 77-17)
FOR THE CONVERSION OF 25 EXISTING APART-
MENT UNITS INTO CONDOMINIUMS ON PROPERTY
GENERALLY LOCATED ON THE NORTH SIDE OF
CHINQUAPIN AVENUE, BETWEEN THE AT&SF
RAILROAD AND GARFIELD STREET. APPLICANT:
HAL POLLARD.
WHEREAS, on January 25, 1978 the Carlsbad City Planning
Commission adopted Resolution No. 1432 recommending that Tentative
Map (CT 77-17) be denied; and
WHEREAS, the City Council of the City of Carlsbad on .?larch 7,
1978 held a public hearing on the matter and received all recommen-
dations and heard all persons interested in or opposed to the
Tentative Map and determined, based on additional staff information
that Tentative Map (CT 77-17) should be approved; and
WHEMAS, said Tentative Map has been declared to be
categorically exempt from the provisions of the City of Carlsbad
Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the findings of the City Council are the finL&ngs
recommended in the Planning Director’s memorandum to the City
Manager, dated February 15, 1978, on file in the Planning Depart-
ment and incorporated by reference herein.
C. That said Tentative Subdivision Map, together with the

provisions €or its design and improvement and subject to the
conditions of this resolution, is consistent with all applicable
general and specific plans of the City of Carlsbad.
D. That Tentative Subdivision Map (CT 77-17) is hereby
approved subject to all applicable requirements of the Carlsbad
Municipal Code and to the satisfaction of the following conditions:
1. Approval is granted for the land described in the
application and with the attachments thereto and as
shown on the tentative tract map submitted, marked
Exhibit B, dated January 17, 1978, on file in the
Planning Department and incorporated by reference
therein.
2. Each unit shall be provided with fire detecting and
warning devices to the satisfaction of the Fire
Chief.
3. Park-in-lieu fees shall be paid to the City to the
satisfaction of the Parks and Recreation Director.
4. Street trees shall be provided to the satisfaction
of the Parks and Recreation Director.
E. That the following conditions are added at the express
request of the applicant:
1. The applicant will construct recreational facilities as shown on Exhibit B-1, attached hereto and made
a part hereof, and the tract map marked Exhibit B is to be revised to reflect the improvements depicted on Exhibit B-1.
2. An automatic fire alarm system will be installed
as outlined in the letter from ADT Security Systems,
dated March 7, 1978, marked Exhibit B-2, attached
hereto and made a part hereof.
