Home My WebLink About1978-04-18; City Council; Resolution 5377RESOLUTION NO. 5377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CONCURRING IN THE FINDINGS OF OVER- CROWDING IN SCHOOL ATTENDANCE AREAS MADE BY THE GOVERNING BOARD OF THE ENCINITAS UNION SCHOOL DISTRICT PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 65971. WHEREAS, the Governing Board of the Encinitas Union School Jistrict, by aldoption of a resolution on January 24, 1978, made 2 series of factual findings regarding conditions of overcrowding in certain school attendance areas and methods of mitigating such zonditions pursuant to California Government Code Section 65971; snd WHEREAS, the Governing Board of the Encinitas Union School District has n.otified the City Council of the City of Carlsbad Df said findings by forwarding a copy of said resolution which is on file with the City Clerk and incorporated by reference herein; and WHEREAS,, the City Council at their April 4, 1978 meeking considered said findings and the factual support therefor contained in said resolution; NON, THEREFORE, BE IT RESOLVED by the City Council of the City of Carls:bad, California, as follows: 1. That the Governing Board of the Encinitas Union School District has made the findings contemplated by Government Code Section 65971 and that said findings are supported by clear and convincing evidence as reflected in the resolution adopted by said District on January 24, 1978. 2. Tha.t the Governing Board of the Encinitas Union School ias notified the City Council of said findings in accordance with Section 65971. 3. That the City Council of the City of Carlsbad, California, 2fter consideration of the evidence contained in said resolution, hereby concurs in the findings contained therein. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad, California, at a regular meeting held on the 18th day of April , 1978 by the following vote, to wit: AYES : NOES : None Councilmen Packard, Skotnicki , Anear and Councilwoman Casler ABSENT : None ATTEST : (SEAL )' 2.
