RESOLUTION NO. 5379
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
CONCURRING IN THE FINDINGS OF OVER-
CROWDING IN SCHOOL ATTENDANCE AREAS
MADE BY THE GOVERNING BOARD OF THE
SAN MARCOS UNIFIED SCHOOL DISTRICT
PURSUANT TO CALIFORNIA GOVERNMENT
CODE SECTION 65971.
WHEREAS, the Governing Board of the San Marcos Unified
School District, by adoption of a resolution on January 3, 1978,
nade a series of factual findings regarding conditions of over-
;.rowding in certain school attendance areas and methods of
nitigating such conditions pursuant to California Government Code
Section 65971; and
WHEREAS, the Governing Board of the San Marcos Unified
School District has notified the City Council of the City of
Carlsbad of said findings by forwarding a copy of said resolution
which is on fi.le with the City Clerk and incorporated by reference
herein; and
WHEREAS, the City Council at their April 4, 1978 meeting
considered said fingings andthe factual support therefor contained
in said resolution;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That: the Governing Board of the San Marcos Unified School
District has made the findings contemplated by Government Code
Section 65971 and that said findings are supported by clear and
convincing evidence as reflected in the resolution adopted by
said District on January 3, 1978.
2. That the Governing Board of the San Marcos Unified School
istrict has notified the City Council of said findings in
ccordance with Section 65971.
3. That the City Council of the City of Carlsbad, California
fter consideration of the evidence contained in said resolution,
ereby concurs in the findings contained therein.
PASSED, .APPROVED AND ADOPTED by the City Council of the
'ity of Carlsbad, California, at a regular meeting held on the
18th day of April , 1978 by the following vote, to wit:
AYES : Councilmen Packard, Skotnicki, Anear and
NOES : None Councilwoman Casler
ABSENT : None
