RESOLUTION NO. 5460
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA OPPOSING PASSAGE OF SENTATE BILL 2160 (MILLS) AND URGING THE STATE LEGISLATURE TO OPPOSE SAID BILL.
WHEREAS, Senate Bill 2160 has been introduced in the
alifornia Legislature, which Bill would provide the unilateral
ower to the Board of Directors of the 22nd California District
gricultural Association to annex to or withdraw their lands from
municipality; and
WHEREAS, such unilateral authority to change municipal
ioundaries could have negative finance and/or service impacts on
,oth cities and counties; and
WHEREAS, this unilateral authority would be contrary to and
.n conflict with the duties and responsibilities of Local Agency
'ormation Commissions and with due process of current law; and
WHEREAS, this Bill appears contradictory to the San Diego
3oard of Supervisors' policy encouraging annexation of urban areas;

WHEREAS, two local governments affected by this Bill, the
3ity of Del Mar and the County of San Diego, are opposed to
SB-2160' s passage; and
WHEREAS, this Bill, if adopted, would constitute a severe
precedent encouraging other agencies to seek similar unilateral
power which could lead to an uncontrollable and non-rational
change in municipal boundaries;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
ity of Carlsbad, California, as follows:
1. The City Council is opposed to the passage of Senate Bill 2160; and
2. The City Council calls upon the California State
Legislature to oppose this Bill in the interest of maintaining a rational process for adjusting municipal boundaries.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
:arlsbad City Council held on the 20th day of June I
