A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
WITH CONDITIONS TENTATIVE MAP (CT 79-5)
FOR A 24-UNIT CONDOMINIUM PROJECT AND
APPROVING CONDOMINIUM PERMIT (CP-4)
FOR SAID PROJECT ON 1.13 ACRES, GENERALLY
LOCATED ON THE NORTH SIDE OF LA COSTA
AVENUE, BETWEEN EL CAMINO REAL AND VIEJO
CASTILLO WAY. APPLICANT: R. A. DUFFY.
WHEREAS, on May 23, 1979, the Carlsbad Planning
Commission adopted Resolution No.1521 recommending to the
City Council that Tentative Map (CT 79-5) and Condominium
Permit (CP-4) be conditionally approved: and
WHEREAS, the City Council of the City of Carlsbad, on
June 5, 1979 held a public hearing to consider the
recommendations of the Planning Commission and to receive
all recommendations and hear all persons interested in or
opposed to Tentative Subdivision Map (CT 79-5) and
Condominium Permit (CP-4); and
WHEREAS, said Tentative Subdivision Map and Condominium
Permit have been declared to have a nonsignificant impact on
the environment and a Negative Declaration has been prepared
and filed in compliance with the requirements of the City
of Carlsbad Environmental Protection Ordinance of 1972;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the findingsof the Planning Commission in
Resolution No. 1521 constitute the findings of the City Council
in this matter.
C. That said Tentative Subdivision Map, together with

the provisions for its design and improvement and subject
to the conditions of this resolution, is consistent with all
applicable general and specific plans of the City of Carlsbad.
D. That Tentative Map (CT 79-5) and Condominium
Permit (CP-4) are hereby approved subject to all applicable
requirements of the Carlsbad Municipal Code and to the
satisfaction of the following conditions:

Approval is granted for CT 79-5/CP-4 as described in the applications, and any attachments thereto, as shown on the site plan for CT 79-5/CP-4, labeled Exhibit A, dated May 1, 1979, on file in the
Planning Department and this project shall be
developed as shown on Exhibit A.
Final landscape and irrigation plans indicating
recreational areas and facilities shall be submitted
and approved prior to issuance of a final map. These improvements shall be installed prior to final occupancy.
All units shall be served with independent utility systems and shall be separately metered in accord- ance with provisions of the Condominium Ordinance.
Water service shall be provided by the Carlsbad Municipal Water District (CMWD). The applicant shall comply with the rules and regulations of the CMWD regarding water service to condominiums. Should extensions to the existing public water
system be deemed appropriate by CMWD, the developer will be required to provide the complete system.
The developer will be required to pay park-in-lieu fees to the City as required by the Director of
Parks and Recreation prior to approval of the final map.
Storage space for each dwelling unit meeting
the requirements of the Condominium Ordinance will
be indicated on building plans prior to approval
of the final map.
The applicant will prepare a reproducible copy
of the final condominium site plan incorporating
all requirements of the condominium permit approval.
This plan will be submitted and approved prior to
approval of the final map.

The applicant will provide school fees to
mitigate conditions of overcrowding as part
of building permit applications. These fees
to be based on the fee schedule in effect at the time of issuance of the building permits.
This subdivision is approved on the express condition that the final map shall not be approved unless the City Council finds, as of the time of
such approval, that sewer service is available to
serve the subdivision and that building permits will not be issued for development on the subject
property unless the City Engineer determines that sewer facilities are available at the time of
application for such permit and will continue
to be available until time of occupancy. If the City Engineer determines that sewer facilities are not applicable, building permits will not be
issued until arrangements, satisfactory to the
City Council, can be made to guarantee that all necessary sewer facilities will be available prior to occupancy. This condition shall be noted on the final map.
. An on-site fire hydrant will be provided as shown on Exhibit A.
. The developer shall install a five foot sidewalk contiguous with the existing curb along the
La Costa Avenue frontage to the satisfaction
of the City Engineer prior to the occupancy of
any of the units.
12. The developer shall relocate the existing drainage inlet structure located within the proposed driveway approach to a curb location east of
the driveway to the satisfaction of the San Diego County Sanitation and Flood Control District and the City Engineer.
13. Prior to the final map approval, the developer shall present to the City Engineer a letter of permission to grade and locate surface improve- ments within the San Diego County Sanitation and Flood Control easement.
14. The developer must receive the approval of the City Engineer for the improvement plans, enter into the appropriate improvement agreement, and post the required security for the construction of public improvements prior to the recordation of the final map.
15. The developer shall receive the approval of the City Engineer for a site grading plan prior to

any construction being performed within the
project site.
In order to provide for reasonable fire protection
during the construction phase, the subdivider shall maintain passable vehicular access to all
buildings, and adequate fire hydrants with required
fire flows shall be installed as recommended by
the Fire Department.
Street trees of a variety approved by the Parks and Recreation Department shall be installed to City specifications at forty foot intervals along the frontage of La Costa Avenue.
The structural section of the paved area for the
north half of the central circular drive shall be
designed to accommodate the turning movements
of fully loaded trash trucks to the satisfaction of the City Engineer.
The proposed project may be phased intwo parts,
each consisting of 12 units, in accordance with
CT 79-5/CP-4 Exhibit B, dated May 7, 1979, on
file in the Planning Department and incorporated
by reference herein.
In the event of phasing of the project, the lot
comprising Phase I shall be provided with full
access and circulation through an easement on the adjacent lot, identified as Phase 11, and to the satisfaction of the City Engineer.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
19th day of June , 1979 by the following vote, to wit:
