A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING AN AGREEMENT BE- TWEEN THE CITY OF CARLSBAD AND OCCIDENTAL LAND
INCORPORATED REGARDING PARK DEDICATION ASSOCIATED WITH DEVELOPMENT PARCELS 12 AND 13 OF MP-133.
The City Council of the City of Carlsbad does hereby resolve
as follows:
1. That, that certain interim parks agreement between the
City of Carlsbad and Occidental Land Incorporated, a copy of
which is attached hereto as Exhibit A and incorporated herein
by reference, is hereby approved.
2. That the Mayor of the City of Carlsbad is hereby
authorized and directed to execute said Agreement for and on
behalf of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council of the City of Carlsbad, California, held on the
7th day of August 1979, by the following vote, to wit:
AYES : Councilmen Packard, Anear, Lewis and
NOES : Councilman Skotnicki Councilwoman Casler

nuaberu 214-3 50-17 and 214-l-50-18 I respectively,
WOK, TIIERTE'GXE, in consideration of the mutual. promises
and. obligaticns of the parties it is agreed as fcllows: that
the 3.35 acre site (Exhibit A) is here'by found to meet the parks
requirenent associated w:i.th development. of APN 214-150-17 and
214-150-18, I;'iaster Plan Parcels 12 and 13 and shown on Exhibit TS
as conditioned below.
(a) Of the 3.95 acres, 2,126 will meet the parks rcquire-
ilaent associated- with a maximm development of 390 units an Master
Plan parcels 12 and 113- The remaining 1.824 acre5 is dedicated
toward meeting other pv-bl ic purpose requixements incltzding , but ,
not 1imi.tec Lo fixe station sites, open space, or ssch other
purpose as Zeterfnined by the City.
(b) Paragraph (a) does not guarantee approval of any
development proposal. of any ir,tensi@y on the subject parcels,

(c) In the event that a deve2opinent proposal is presented
and zip?rovei'l. in excess of 390 units, additional park land8 fees
or combination therm€ may be required.
(6) In ishe event that Less than 390 units are approved
cn the site (Exhibit ti), the City will not bs reqaired to
credit excess requiremerks elsadwere nor shall- the City be
required to relinqciskr any of the dedication described in
Exhibit A.
(e) Execution of this agreement shall in no way 3.init or
preclude the City or other agencies from acquirifig additional
dedication or easements for purposes other than parks in connec-
tion with development of the subject site.
