RESOLUTION NO. 5997
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING RESOLUTION 5580
REVISING THE AMOUNT OF FEES TO BE REQUIRED AS A
CONDITION OF APPROVAL FOR RESIDENTIAL DEVELOP-
MENT WITHIN CERTAIN AREAS OF THE SAN MaRCOS
UNIFIED SCHOOL DISTRICT.
WHEREAS, pursuant to Chapter 4.7, Division 1, Title 7 of the
Zalifornia Government Code, the City Council of the City of Carls-
2ad, California has adopted a School Facilities Dedication and
?ee Ordinance (Carlsbad Municipal Code Chapter 21.55); and
WHEREAS, Section 21.55.150 of the Carlsbad Municipal Code
?rovides that the standards for the amount of fees to be required
?ursuant to such ordinance shall be determined by the City Council
2nd set by resolution, The City Council's determination is to be
nade after consideration of recommendations from the governing
Doard of the affected school district; and
WHEREAS, the City Council established standards for the amount
Df fees to be required pursuant to Chapter 21.55 in Resolution
Yo. 5580; and
WHEREAS, amendments to Chapter 4.7, Division 1, Title 7 of the
3alifornia Government Code and to Chapter 21.55 of the Carlsbad
3unicipal Code limit the amount of fee that can be required; and
WHEREAS, the City of Carlsbad has requested the San'Marcos
Unified School District to submit revised fee recommendations; and
WHEREAS, the City Council is in receipt of recommendations
in regards to revised amount of fees from the San Marcos Unified
School District. Their recommendation is attached hereto as
Exhibit A, and is made a part hereof; and
WHEREAS, the City Council fully considered the matter at the

egular meeting of November 20, 1979 at which the City Council
etermined to concur in the revised standards as recommended by
he Board of the San Marcos Unified School District;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
ity of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the standard for the amount of fees to be required
s a condition of approval for residential developments within
.hat portion of the City of Carlsbad, which is also within the
loundaries of the San Marcos Unified School District, shall be
.s contained in Exhibit A.
C. This determination is based upon the City Council's
:oncurrence in the recommendations made by the Governing Board of
:he San Marcos Unified School District, including the facts support-
.ng such recommendations as contained in Exhibit A.
D. Unless the decision-making body especially determines to
:he contrary, the City Council hereby determines that the following
iindings and requirements shall apply to any residential develop-
lent of

fifty units or less:
All such developments shall be required to pay fees
in accordance with the schedule in Exhibit A.
The City Council has reviewed that portion of the General Plan which applies to the San Marcos Unified School District and finds that it provides for the location of public schools.
That the fees to be paid shall be used for the
purpose of providing interim school facilities.
That the fees to be paid for each unit bear a reasonable relationship to the burdens placed on the School District by such unit and that the fees will be used to mitigate that burden.
That the school facilities to be funded by the fees are

consistent with the City's General Plan.
E. The standards adopted by this resolution do not at this
time require the dedication of land. The San Marcos Unified
School District is developing standards regarding such dedications.
When the District is prepared to make their recommendation in that
regard, the City Council intends to amend this resolution to
include provisions for requiring the dedication of land as they
determine to be in the public interests. and adjourned

RATIONALE FOR FEE SCHEDULE FOR INTERIM FACICITIES/S, B. 201
The passage of Proposition 13 remwed all existing sources of funds for school facilities except S.B. 201. relocatable classrooms and plan on replacing them with permanent buildings at the end of the lease period. This fee schedule, therefore, is based on purchasing standard stze relocatable classrooms with appurtenant costs of site preparation, uti1 ity connections, engineering, walkways and furniture and equi-pment.
It is no longer feasible to lease
The present cost of a classroam and attached costs is $39,500,
It is assumed that thfs fee schedule wtll be in force for approxtmately one year. Best indications at this point is that this rate will increase in the near future. A modest 10% inflation factor is ,included,
The inflation rate tn the construction industry in running 1% per month.
At the present time, 10% of the distri.ctis classrooms are devoted to special education classes. This proporti-on -?s fncreasing markedly due to Federal legislation requiring programs for all handicapped students by type of handi- cap. The number of additional classrooms needed for special education over the next two years approximates the mber needed for regular students.
The district contract wTth the teachtng personnel calls for a maximum average class size of 31. This has been the practice in the district for some time, Using 31 students per classroom as a dfvfsor, the cost per student is $1542.
The student generation factors computed by the San Diego Department of Education for the San Marcos Unified School District are 0.77 students per dwelling unit in single family dwellfngs and 0.28 for attached dwelling units (apartments, condominiums, etc. 1 generated per dwelling unPt becmes $1,188 for single family units and $432 for attached units.
Accordtngly, the cost to house the students
It is assumed that the avwage single fmi-ly dwell ing unit in San Marcos has three bedrogms, so the cost per bedroom becomes $396; $1 ,I88 per dwelling unit - 3 bedroams per dwelling untt, dwelling unit has two bedrooms, so the cost per bedroom is $216. The reason for assessing the fee on a per-bedroom basts is that the number of bedrooms has some positive relation to the nunbet. of children in the famtly?
