RESOLUTION NO. 5998
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING RESOLUTION 5580 REVISING THE AMOUNT OF FEES TO BE REQUIRED AS A CONDITION OF APPROVAL FOR RESIDENTIAL DEVELOP- MENT WITHIN CERTAIN AREAS OF THE SAN DIEGUITO
UNIDH EIGR SCHOOL DISTRICT.
WHEREAS, pursuant to Chapter 4.7, Division 1, Title 7 of the
Ialifornia Government Code, the City Council of the City of Carls-
)ad, California has adopted a School Facilities Dedication and
pee Ordinance (Carlsbad Municipal Code Chapter 21.55); and
WHEREAS, Section 21.55.150 of the Carlsbad Municipal Code
irovides that the standards for the amount of fees to be required
iursuant to such ordinance shall be determined by the City Council
ind set by resolution. The City Council's determination is to be
nade after consideration of recommendations from the governing
>oard of the affected school district; and
WHEREAS, the City Council established standards for the amount
If fees to be required pursuant to Chapter 21.55 in Resolution
Jo. 5580; and
WHEREAS, amendments to Chapter 4.7, Division 1, Title 7 of the
Ialifornia Government Code and to Chapter 21.55 of the Carlsbad
ilunicipal Code limit the amount of fee that can be required; and
WHEREAS, the City of Carlsbad has requested the San Dieguito
Jnion High School District to submit revised fee recommendations;

WHEREAS, the City Council is in receipt of recommendations
in regards to revised amount of fees from the San Dieguito Union
ligh School District. Their recommendation is attached hereto as
Zxhibit A, and is made a part hereof; and

WHEREAS, the City Council fully considered the matter at the
*egular meeting of November 20, 1979 at which the City Council
Letermined to concur in the revised standards as recommended by
:he Board of the San Dieguito Union High School District;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
lity of Carlsbad as follows:
A. That the above recitations are true and correct.
B. That the standard for the amount of fees to be required
is a condition of approval for residential developments within
:hat portion of the City of Carlsbad, which is also within the
loundaries of the San Dieguito Union High School District, shall
)e as contained in Exhibit A.
C. This determination is based upon the City Council's
:oncurrence in the recommendations made by the Governing Board of
:he San Dieguito Union High School District, including the facts
supporting such recommendations as contained in Exhibit A.
D. Unless the decision-making body especially determines to
:he contrary, the City Council hereby determines that the following
findings and requirements shall apply to any residential develop-
nent of

fifty units or less:
All such developments shall be required to pay fees in accordance with the schedule in Exhibit A.
The City Council has reviewed that portion of the General Plan which applies to the San Dieguito Union High School District and finds that it provides for
the location of public schools.
That the fees to be paid shall be used for the purpose of providing interim school facilities.
That the fees to be paid for each unit bear a reasonable relationship to the burdens placed on the School District by such unit and that the fees will be used to mitigate that burden.

5. That the school facilities to be funded by the fees are consistent with the City's General Plan.
E. The standards adopted by this resolution do not at this
ime require the dedication of land. The San Dieguito Union High
chool District is developing standards reqarding such dedications.

nclude provisions for requiring the dedication of land as they

Grading: Preparation of a site is required to put the building in place. The school district is usually responsible to prepare the site ready for foundations.
Architect fees, etc.: Each building requires architectural service; other fees are required to the State Department of Education, the State Architect, etc. for plan conformance. Engineering services are required for site work and utilities. inspector is required during construction.
A walk ten feet wide surrounding the building has been District standard for recent portables.

Uti 1 i ties: Cost can only be an estimate since each location is different. Some campuses will require more, some less, than the estimated amounts due to the location of existing available lines.
This is an esti:nate of additional expenses during construction. Contingency: .
Toilet facilities: As needed, these would be incorporated on a campus, but are not needed for each building. provide adequate funds to provide these as they are required. The facility could also provide a custodial room and minimum storage.
If the amount shown is collected for each building put in place, the tenth busiding could also include the lease of a resource center as the required funds wolrfd be available for use.
