HomeMy WebLinkAbout1980-01-15; City Council; Resolution 60594 1( 1: 1; Q 6 15 2c 21 22 22 24 25 26 27 28 RESOLUTION NO. 6059 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE SUBDIVISION MAP (CT 79-13) FOR A 13-UNIT CONDOMINIUM PROJECT AND APPROVING CONDOMINIUM PERMIT (CP-17) FOR SAID PROJECT, GENERALLY LOCATED ON THE SOUTHWEST CORNER OF NAVARRA DRIVE AND VIEJO CASTILLA WAY, LA COSTA. APPLICANT: JOSEPH. IN SOUTH WHEREAS, on November 20, 1979 the City Council of the City of Carlsbad held a public hearing to consider the Planning Commission's recommendation for denial of Tentative Subdivision Map (CT 79-13) and Condominium Permit (CP-171, and to receive all other recommendations and hear all persons interested in or opposed to said Tentative Subdivision Map and Condominium Permit; and WHEREAS, at the conclusion of said meeting the City Council directed the matter be referred back to the Planning Commission for preparation of findings and conditions consistent with approval of the Tentative Subdivision Map and Condominium Permit and to return the matter for further consideration; and WHEREAS, on January 2, 1980, the City Council considered said findings and conditions; and WHEREAS, said Tentative Subdivision Map and Condominim. Permit have been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the findings of the Planning Commission as contained in the memorandum to the Planning Commission, dated December 12, 1979 (revised December 26, 19791, on file in the Planning Department and incorporated by reference, constitute the findings of the City Council in this matter. C. That said Tentative Subdivision Map, together with the provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. D. That Tentative Subdivision Map (CT 79-13) and Condominium Permit (CP-17) are hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the following conditions: 1. This approval is granted for that portion of land described in the application CT 79-13/CP-17 and development shall occur substantially as shown on Exhibits A, dated September 12, 1979, and B, C, D, and E, dated September 27, 1979, on file in the Planning Department and incorporated by reference herein, except for modifications required herein. 2. The applicant shall prepare a reproducible copy of the final condominium site plan incorporating all requirements of the condominium permit approval, and shall be subject to the approval of the Planning Director, prior to final map approval. 3. The applicant shall comply with all rules and regulations of the sewer and water districts regarding water and sewer service to the subject property. 4. The applicant will provide school fees to mitigate conditions of overcrowding as part of building permit applications. These fees shall be based on the fee schedule in effect at the time of building permit application. the express condition that building or grading permits will not be issued for development of the subject property unless the City Engineer determines that such sewer facilities are available at the time of application for such permits and will continue to be available until time of occupancy. If the City Engineer determines that sewer facilities are not available, building permits will not be issued. The applicant shall agree to delineate pedestrian pathways along both sides of the driveway through the use of stamped concrete embossing or other similar method. The final condominium plan shall reflect this condition. construction period, the applicant shall maintain passable vehicular access to all buildings. In addition, adequate fire hydrants and/or stand pipes with required fire flows shall be installed on and/or off-site, as recommended by the Fire Chief or his designee. 13.
