RESOLUTION NO 3213
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
TO PROVIDE PARKING FOR HANDICAPPED
PERSONS.
WHEREAS, the City Council of the City of Carlsbad, California
desires to provide adequate parking in the City for handicapped
persons: and
WHEREAS, the City Council finds that there are certain
privately owned and maintained off-street parking facilities
generally held open for use of the public for purposes of
vehicular parking; and
WHEREAS, the City Council has held a public hearing after
notice to the owners and operators of the privately owned
off-street parking facilities; and
WHEREAS, the City Council is authorized, by Vehicle
Code Sections 21107.8, 22507.8 and 22511.8 to enact this
resolution;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Carlsbad, California establishes the following
regulations pertaining to handicapped parking:
1. That the above recitations are true and correct.
2, That the City Manager shall designate parking stalls
or spaces on any street or on any publicly owned, leased or
controlled off-street parking facility for exclusive use by
handicapped persons.
3. That the City Council finds that the following
privately owned and maintained off-street parking facilities
are generally held open for use of the public for purposes of

md made a part hereof.
4. That the owners or operators of a privately owned
md maintained off-street parking facility shall designate
iandicapped parking stalls or spaces and shall provide at the
iwner's or operator's own expense identifying marks and signs
IS provided in Sections 5 and 6. The location and number of
:he spaces or stalls shall be approved by the City Manager or
lis designee.
5. That all handicapped parking stalls or spaces shall
le designated either by blue paint on the curb or street adjacent
:o the space or by blue painted parking space lines. Stalls
;hall be at least twelve (12) feet wide. In addition, all
iandicapped parking stalls or spaces shall be designated by a
;ign posted immediately adjacent to and visible from each stall
)r space. Such sign shall consist of a profile view of a
vheelchair, with occupant, in white on a blue background as shown
in Appendix A.
6. That all off-street parking facilities shall have posted
in a conspicuous space at each entrance a notice not less than
17" x 22" in size, with letters not less than 1" in height which
:cads :
"Unauthorized vehicles not displaying distinguishing
placards or license plates issued for physically
handicapped persons parking in handicapped zones
will be cited. Veh.C.Sec. 22507.8."
7. That any person who parks a vehicle not displaying
listinguishing placards or license plates issued for handicapped
Dersons in any parking stall or space designated according to this
resolution shall be guilty of violating Vehicle Code Section 22507.8

8. The parking restrictions established by this resolution
shall be operative from 6 A.M. to 11 P.M., seven days a week
unless otherwise approved by City Council resolution.
9. The parking zones established under this resolution
shall be subject to any temporary parking restriction imposed
according to law.
10. This resolution is adopted pursuant to authority granted
in Vehicle Code Sections 21107.8 and 22511.8.
PASSED, APPROVED AND ADOPTED by the City Council of the
adjour ed City of Carlsbad, California, at q' regufar meeting held on
the 26th day of August , 1980 by the following vote, to wit:
