RESOLUTION NO. 6321
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING RELINQUISHMENT OF A PORTION OF THE BUENA VISTA CREEK CHANNEL FROM THE STATE OF CALIFORNIA, DEPARTMENT OF TRAMS PORTAT I ON
WHEREAS, the State of California has served upon the City of Carlsbad
the notice of intention of the Department of Transportation to relinquish a
portion of the Buena Vista Creek Channel on the southerly side of that par-
ticular freeway referred to as ll-SD-78; and
I
WHEREAS, the City Council has determined it is necessary and in the public
interest to accept such proposed re1 inquishment; and
WHEREAS, by the acceptance of this relinquishment there is vested in the
City of Carlsbad, all of the interest which the State of California might have
in right, title, in and to that portion of the State Highway hereinabove de-
scri bed;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Carlsbad does, in behalf of the City of Carlsbad, agree to accept the channel on
the southerly side of that particular freeway 71-SD-78, more particulary de-
scribed as Segment l in Exhibit A, which is attached hereto, and made a part
hereof as if fully set forth.
PASSED, APPROVED AND ADOPTED, by the City Council at a regular meeting
held the 7th day of &obey , 1980, by the following vote, to wit:
