APPLICANT: LA COSTA/DAON. WHEREAS, on June 10, 1981, the Carlsbad Planning :ommission adopted Resolution No. 1820 recommending to the City Iounci1 approval of a 560 unit Tentative Subdivision Map (CT 81- 16) and La Costa Development Plan (LCDP 81-1) for said project on ?roperty generally located on the east side of Rancho Santa Fe Zoad, between Olivenhain Road and the future Mission Estancia (East), more particularly described as: Portions of Lots 4 and 9 of Rancho Las Encinitas, County of San Diego, according to Map No. 848, filed June 27, 1898; 2nd WHEREAS, this application has been processed according to the provisions of Section 111. B. 3. of the La Costa Master Plan (MP-l49(E))(Ordinance No. 9570) and has been found to meet the requirements of said master plan; and WHEREAS, said Tentative Subdivision Map and La Costa Development Plan have been declared to have a nonsignificant impact on the environment and a Negative Declaration has been prepared and filed in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980; and WHEREAS, the City Council of the City of Carlsbad did on July 7, 1981 hold a public hearing to consider the recommendations and hear all persons interested in or opposed to ,. That B. That Resolution No. 1820 in this matter. C. That the provisions for the above recitations are true and correct. the findings of the Planning Commission in constitute the findings of the City Council said Tentative Subdivision Map, together with ts design and improvement and subject to the conditions of Resolution No, 1820, is consistent with the La Costa Master Plan and all applicable general and specific plans of the City of Carlsbad. D. That Tentative Subdivision Map (CT 8116) and La Costa Development Plan (LCDP 81-1) are hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the conditions contained in Planning Commission Resolution No. 1820, dated June 10, 1981, marked Exhibit A, attached hereto and made a part hereof, except as follows : 1. Condition No. 12 is revised by the addition of the following: "Said Plan shall include express provisions for the open space area adjacent to Rancho Santa Fe Road which shall be heavily wooded. " 2. Conditions No. 58, No. 59 and No. 60 regarding reclaimed water use are deleted. At the time the final map is /// -2- submitted to the City Council for approval, the applicant shall take whatever steps are necessary to comply with the City Council's policy for reclaimed water applicable to the area as it exists at that time. Seneral Conditions: ! Approval iC3granted for CT 81-16/LCDP 81-1, as shown on Exhibit(s) A-C, dated June 4, 1981 and Exhibits D-Z, dated May 6, 1981, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. All references to Areas 'A', 'B' and IC' in these conditions shall mean those areas indicated on Exhibit 'A', dated June 6, 1981. This project is approved upon the express condition that the final map of any phases shall not be approved unless the City Council finds as of the time of such approval that sewer servic is available to serve the subdivision. These fees shall be based on the fee schedule in effect at the time of building permit application. Also, the applicant shall comply with the requirements of the existing school agreement between the La Costa Land Company and the Encinitas School District. Approval of this request shall not excuse compliance with all applicable sections of the Zoning Ordinance, the La Costa Mast Plan and all other applicable city ordinances in effect at tin of building permit issuance. Planning Department The applicant shall prepare a reproducible,mylar of Exhibits 'B' , 'C' , and ID' incorporating the conditions contained herein. Said plans shall be submitted to and approved by the Planning Director prior to the issuance of building permits. The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Planning Department prior to final map approval of the first phase of this project. The applicant shall prepare a detailed landscape and irrigatic plan which shall be submitted to and approved by the Planning Director prior to the issuance of any building permits. Said plan shall include all common areas to be maintained by the homeowner's association. The applicant shall prepare a detailed site plan, landscape pl and irrigation plan for the open space corridor indicated on Exhibit 'A' Said plan shall include additional landscaping, meandering trail system along its entire length and rest stop facilities. Saj-d plan shall be approved by the Planning Director prior to final map approval of any phase. The landscaping and improvements shall be installed immediately after grading of any adjacent phases in Areas 'A' or IC'. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposed for this development shall be designed in conformance with the La Costa Master Plan and shall require review and approval of the Planning Department prior to installation of such signs. Any trash receptable areas within the condominium development (Area IC') shall be enclosed by a 6 foot high masonry wall wit gates pursuant to city standards. Location of said receptacle shall be approved by the Planning Director. The applicant shall submit a street name list consistent with the city's street name policy subject to the Planning Director approval prior to final map approval. The project shall provide bus stop facilities at locations subject tq the satisfaction of the North County Transit District. Said facilities shall at a minimum include a bench, free from advertising and a pole €or the bus stop sign. The bench and pole shall be designed in a manner so as to not detract from the basic architectural theme of the project and said design shall be subject to the approval of the Planning Director and North County Transit District. The bomanite/concrete treatment is specifically not approved c public streets. All streets shall be designed and paved pursuant to existing c!ity standards. The lots located on the cul-de-sac on E Street in Area 'A' and on J Street in Area 'B' shall be redesigned as follows: a) One lot on each cul-de-sac shall be deleted. b) The remaining lots shall be evenly spaced out to provide maximum street frontage for each lot. A revised tentative map showing this redesign shall be submitted to and approved by the City Engineer and Planning Director prior to final map approval for this phase. The applicant shall reconstruct and landscape all cut and fill slopes in accordance with Section 11,06.130 of the Carlsbad Municipal Code so that they appear in a natural stater blendin! in with the natural slopes. Such grading shall be subject to City Engineer and Planning Director approval prior to issuance of any building permits in the phase being graded. City Engineer and Planning Director shall have the discretion . require additional grading work to ensure that this condition . met. Both the A revised plan for the recreation facility in Area 'E' shall bc submitted to and approved by the Planning Director prior to final map approval of the first phase in Area 'B'. A detailed street signing and street lighting plan shall be submitted to and approved by the City Engineer and Planning Director prior to final map approval in the first phase each o Area 'A', 'E', or 'C' . The street lights shall meet- all city standards relating to illumination and light type. Grad: shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspectior and testing to insure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. 1.i 1€ 15 2c 21 Upon completion of grading, the developer shall insure that an "as-graded" geologic plan shall be submitted to the City Ehgineer. The plan shall clearly show all the geology as exposed by the grading operation, all geologic corrective measures as actually constructed and must be based on a contou map which represents both the pre and post site grading. This plan shall be signed by both the soils engineer and the engineering geologist. similar drafting film and shall become a pe'rmanent record. No grading shall occur outside the limits of the subdivision unless a letter of permission is obtained from the owners of t affected properties. Circulation ani? Phasing: The subdivision has been divided into three areas (labeled A, and C) which may be developed independently. All improvements must be constructed within a phase prior to the occupancy of any units within that phase. Except as noted in conditions below, final maps may be recorded in any sequence if the City Engineer determines traffic circulation and fire access will k adequate. Minor adjustments to the phase boundaries may be approved by the City Engineer if traffic circulation is not affected. Area A: Phase I shall be recorded and constructed first. Phase 11 shall be second and shall be recorded and constructed concurrently with Phase V or the dedication and improvement of "D" Street within Phase V. Area B: Phase I shall be recorded and constructed first. Phase VI may record at any time after Phase I. Phases 11, IV and V shall be recorded and constructed concurrently or concurrent with the recordation of any of these phases, "I", "J", "K", and "L" Streets shall be dedicated and improved. Phase I11 must be recorded concurrent with or subsequent to Phase V or the dedication and improvement of "L" Street. Phase V may record after Phase 1 but shall be concurrent with Phase I11 or the construction of 'HI Street. Area C: Either Phase I or Phase I1 shall be recorded first, "N" Street shall be completed as a loop street concurrent wit1 Phase 11. Phase I11 must be recorded concurrent with or subsequent to Phase I. "0" Street must be completed as a 1001 street concurrent with Phase 111. "A" Street must be dedicated and improved (full width) from Rancho Santa Fe Road to 'IC" Street with Phase AI, to "D" Strec with Phase AIL, to 'IF" Street with Phase BI and to Calle Acen with the recordation of any other phase in Areas B or C. Mission Estancia from Rancho Santa Fe Road to Calle Acervo anc Calle Acervo from Mission Estancia to "A" Street shall be dedicated and improved concurrently with the final map for tht seventh phase to record within $rea B and C. Calle Acervo along the subdivision boundary in Area B shall be dedicated and improved concurre2t with the last phase in Area Be . 1: , ZE 15 2( 22 2: 2; 2L 2: 21 2'; 2t The east side of Rancho Santa Fe Road shall be widened and/or striped to provide a separate southbound left turn lane into I' Street. The widening and/or striping shall extend approximate 600 feet north of the intersection and approximately 400 feet south and shall be designed to the satisfaction of the City Engineer. This work shall be done concurrently with the improvement of any portion of "A" Street. Similar widening and/or striping shall be done on Rancho Santa Fe Road at the intersection of Mission Estancia at the time Mission Estancia constructed. Rancho Sar;ta Fe Road shall be improved between Olivenhain Road and Mision Estancia at the time the final map is approved for the fourth phase in the subdivision or at the time the traffic signals are installed at either Rancho Santa Fe Road and "A" Street or Rancho Santa Fe Road and Mision Estancia. The developer shall sign an improvement agreement and bond for half street improvements at the intersection of Rancho Santa I Road and 01ivenhain Road at the time Rancho Santa Fe Road is improved. Land for all public streets and easements shown on the tentative map shall be dedicated at the time of the final map approval for the phase requiring said dedication and shall be granted to the city free and clear of all liens and encumbrances. Direct access rights for all lots abutting Rancho Santa Fe Roz shall be waived on the final map. All public streets shall be improved by the developer based or the typical sections shown on'the tentative map and in conformance with City of Carlsbad Standards prior to occupancl of any buildings within the phase requiring said improvements, The developer shall comply with all the rules, regulations anc design requirements of the respective sewer and water agencies regarding services to the project, The design of all private streets and drainage systems shall k approved by the City Engineer prior to approval of the final map. The structural section of all private streets shall conform to City of Carlsbad Standards based on R-value tests. All private streets and drainage systems shall be inspected bi the city and the standard improvement plan check and inspectic fees shall be paid prior to approval of the final map. All private streets and drainage systems shall be maintained 1: the homeowner's. This responsibility shall be clearly stated the CC&R's. All concrete terrace drains shall be maintained by the home- owner's association (if on commonly owned property) or the individual property owner (if on an individually owned lot). An appropriately worded statement clearly identifying the responsibility shall be placed in the CCFtR's. I' Y S n L 3. Islands at the east and west ends of "A" Street shall be designed as median islands and shall be subject to the approva:- of the City mgineer. If at the end of the four year period a permanent facility has not been built to replace said temporary facility, then the applicant shall lease the temporary facility to the city at a fair market price for period to be determined by the city, not to exceed four years . If Mision Estancia West Reclaimed Water Use 58) The applicant shall agree to utilize reclaimed water, in Type form, on the subject property in an amount that equals or exceeds the amount of sewage generated by the project or otherwise approved by the City mgineer. 73 59) The reclaimed water irrigation system shall be maintained and operated by the Leucadia Water District consistent with the requirements of the city of Carlsbad, under a contractural agreement with the homeowner's association that is to give thc district total assurance that they would always have the ability to discharge the effluent. 60) Construction of the reclaimed water system shall comply with Title 17 of the California State Administration Code by requiring a water master on the job to monitor pipe connections. Low trajectory sprinklers shall be utilized and the irrigation rate shall be regulated so that there will be n runoff . Fire Department-. 61) The applicant shall provide either one of the following fire mitigation measures: a) PC RES0 The specific site and facilities to be provided shall be approved by the Fire Chief prior to final map approval of any phases in Areas A, B, and C. The facility shall be operational prior to final .occupancy of the 200th unit of Areas A, 3, and C. #1820 .10 4 Prior to recordation of the final map for the first phase of Area A, B, or C, whichever occurs first, a comprehensive recreational storage plan to accommodate recreational vehicles including horse trailers, campers, boats, mobile homes, etc. shall be submitted to and approved by the Planning Director. Said plan shall incorporate one of the three approaches outlined in the La Costa Master Plan (P. 111-10). The proposed security gate system shall be subject to approval of both the Police and Fire Departments prior to approval of the final map for any phases in Subarea 'C' All private streets in Area C, other than the loop streets, shall be kept clear of parked vehicles at all times, and shall have posted "NO ParkinglFire Lane/Tow Away Zone" according to the provisions of the Nunicipal Code. Fire retardant roofs shall be required on all structures subject to the approval of the Building and Fire Depzrtments. Brush clearance shall be maintained within 30 feet of each residence. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department €or approval prior to the issuance of any building permits.
