RESOLUTION NO, 6696

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS TENTATIVE SUBDIVISION MAP (CT 81-33) FOR A 10- UNIT CONDOMINIUM PROJECT AND APPROVING
CONDOMINIUM PERMIT (CP1179) FOR SAID PROJECT ON
PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF UNICORN10 STREET. APPUICANT: CERRO DEL SOL.
WHEREAS, on September 23; 1981 the Carlsbad Planning
Commission adopted Resolution No. 1867 recommending to the City
Council that Tentative Subdivision Map (CT 81-33) and
Condominium Permit (CP-179) be conditionally approved; and
WHEREAS, the City Council of the City of Carlsbad, on
October 6, 1981, held a public hearing to consider the
recommendations and hear all persons interested in or opposed to
Tentative Subdivision Map (CT 81-33) and Condominium Permit
(CP-179); and
WHEREAS, said Tentative Subdivision Map and Condominium
Permit have been declared to have,a nonsignificant impact on the
environment and a Negative Declaration has been prepared and
filed in compliance with the requirements of the City of Carlsbad
Environmental Protection Ordinance of 1980;

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above rec2tations are true and correct.
B, That the findings of the Planning Commission in
Resolution No. 1867 constitute the findings of the City Council
in this matter.
C, That said Tentative Subdivision Map, together with
the provisions for its design and 'improvement and subject to the

conditions of this resolution, is 'consistent with all applicable
general and specific plans of the City of Carlsbad.

D. That Tentative Subdivision Map (CT 81-33) and
Condominium Permit (CP-179) are hereby approved subject to all
applicable requirements of the Carlsbad Municipal Code and to
the satisfaction of the conditions contained in Planning
Commission Resolution No. 1867, dated September 23, 1981, marked
Exhibit A, attached hereto and made a part hereof.
PASSED, APPROVED, AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California, on the

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING CERTIFICATION OF ENVIRONMENTAL IMPACT REPORT
(EIR 81-1) FUR A PROJECTIGENERALLY INCLUDING A
GENERAL PLAN AMENDMENT A~D MASTER PLAN REVISION.
APPLICANT: OCCIDENTAL COMPANY CASE NO:- --EIR 81-1
WHEREAS, on October 14, 1981, the Planning Commission,
of the city of Carlsbad, held a public hearing on EIR 81-1
pursuant to the provisions of Title 19 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning C4mmission has considered the
comments and documents of all those persons testifying at the
public hearings; and

WHEREAS, the Planning Commission has received EIR 81-1
according to the requirements of (Title 19 of the Carlsbad
Municipal Code;
NOW, THEREFORE, BE IT RESOLVED by the Planning
Commission of the city of Carlsbad as follows:

I That the foregoing recitations are true and correct.
That the Environmental Impac,t Report EIR 81-1 will be amended to include the commqnts and documents of those testifying at the public hearing and responses thereto hereby found to be in good qaith and reason by incorporating a copy of the minutes of saild public hearings into the
report .
That the Planning Commission finds and determines that the
Environmental Impact Report'EIR 81-1 has been completed in conformance with the California Environmental Quality Act, the state guidelines implementing said Act, and the
provisions of Title 19 of the Carlsbad Municipal Code and that the Planning Commission has reviewed, considered and evaluated the information contained in the report.
That the Environmental Impapt Report EIR 81-1 as so amended
and evaluated, is recommended for acceptance and I
certification as the final Environmental Impact Report and that the final Environmental Impact as recommended is adequate and provides reasonable information on the project and all reasonable and feaslibie alternatives thereto, including no project,

I. That each and every significant environmental impact
identified in the Environmentdl Impact Report would be overruled or counterbalanced dy changes or alteration in the project which would mitigate against said adverse impacts
or, in certain circumstances,'that mitigation of such adverse impacts would not be feasible under the
circumstances and under the economic and social needs
objectives and concerns in providing the private improvements all as identified in the Environmental Impact
Report and which, if the project were to be approved, would be included as conditions of approval of the project.
