RESOLUTION OF TEE CITY COUXCIL OF THE CITY OF (XRISSAD,
(YLIFOIWIA, FEQUESTING P33 STATE TO FTKJD CEKt'AIN POR- TICNS OF TllE cc)sTs OF W- 911 EDERGENCY TELEPHONE SYSTJZX.
FiTHEREAs, Assembly Bill 515, adopted in 1972, established a one-nm-er emzgenq telephone system throughout the State of California, designated as
911, and required that the system be fully operational by December 31, 1982; and
WHEFEAS, Senate Bill 1180, signed into law September 28, 1979, mandated. a users tax of one-half of one percent be collected on the telephone billing to each residential or centrex subscriber, which would provide sufficient funding
for the installation and servicing of Lle system; and
h-, the City of Carlsbad has nm ccsnplied with the State's mand.ate and provided the necessary telephone equiprent for what is denad an adequate
emrgency telephone service for the citizens of Carlsbad; and
WHEREAS, the State of California is paying for the installation of all the emrgency telephone equiprent except that equipmt classified as incremntal
cost equiprent; and
WREX, the City of Carlsbad, after due consideration of the cost for
installing an autmtic location indicator, chose not to install Lle apparatus.
This apparatus was considered an added feature khat must be paid for as an
incremental cost bome by each agency.
IJHEREFS, sufficient funds have Seen and are nm king collecte6 to cover
the costs of the automatic location indicator, if the funds were not loaned to otler State accounts, and if the interest accruing to the funds was continued
in credit to the Bnergency Telephone Users Tax account; and
WE3EAS, the State of California has borrowed 20 million dollars fran the users tax account as we11 as diverting all interest accmd since 1979 fr"
mnies in the account and placing all of the sm in Lk State General Fund.
IKW, THEREFORE BE IT RESOLVED by the City Council of the City of Carlsbas,
that the funds brmwed from the Eh-ergency Telephone Users Tax account and all
interest accruing to Cat account I=e placed back into that account; and
BE IT E'URTJBR TZESOLVED that the City Council of t"le City of Carlsbad
requests Llat the incrmtal costs which would be incurred by the City of
Carlsbad for the installation and monthly servicing of the autmatic locating equiprentke refunded to the City of Carlsbad Sy the State of California from
the Emrgenq Telephone Users Tax account.
