RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DIRECTING
THE CONSTRUCTION OF WORKS OF IMPROVEMENT AND CALLING FOR CONSTRUCTION BIDS
WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD,
CALIFORNIA, has instituted proceedings pursuant to the provisions
'ijof Chapter 27 of the "Improvement Act of 1911", being Division 7

!/of the Streets and Highways Code of the State of California, for
'the construction of certain authorized improvements in a special
9; 81assessment district known and designated as
ASSESSMENT DISTRICT NO. 83-1
(MONROE STREET)
12 j(hereinafter referred to as the "Assessment District"); and,
WHEREAS, the property owner or owners within the boun-
of the Assessment District have not commenced the works of
1.51improvement within sixty (60) days upon receiving notice to do so
iG/by the Superintendent of Streets, and at this time the City
~~I~Council desires to authorize the bidding on the works of improve-
18jiment for the above-referenced Assessment District; and,
WHEREAS, it is also necessary to determine the prevail-

rate of wages for the various classifications of workmen
in the performance of said work.

22 li NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:

this time to determine the actual damage which will be sustained
by reason of any such delay, but that sums set forth therein is a
reasonable amount for said liquidated damages and said amount is
lot being imposed as a penalty.
SECTION 6. This Resolution is adopted pursuant to the
irovisions and authorizations of Section 5880 of the Streets and
{ighways Code of the State of California.
