RESOLUTION NO. 7471
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING WITH CONDITIONS AN
AMENDMENT TO A PREVIOUSLY APPROVED 96-UNIT PLANNED
UNIT DEVELOPMENT PUD-8(A) TO ALLOW A CHANGE OF
PRODUCT TYPE FROM DUPLEX UNITS TO ZERO LOT-LINE
SINGLE FAMILY RESIDENCES ON SAID PROJECT GENERALLY
LOCATED NEAR THE INTERSECTION OF MONROE AVENUE AND
HOSP WAY
APPLICANT: McKELLAR DEVELOPMENT
CASE NO: PUD-8 (A)
WHEREAS, on December 14, 1983 the Carlsbad Planning
Commission adopted Resolution No. 2230 recommending to the
City Council that an amendment to a previously approved 96
unit Planned Unit Development (PUD-8(A)) to allow a change
of product type from duplex units to zero lot-line single
family residences in phases 2-5 of CT 77-2/PUD-8 be
approved; and
WHEREAS, the City Council of the City of Carlsbad,
on January 3, 1984 held a public hearing to consider the
recommendations and hear all persons interested in or
opposed to amended Planned Unit Development (PUD-8(A)); and
WHEREAS, a notice of prior compliance was issued by
the Land Use Planning Manager on November 18, 1983,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 2230 constitute the findings of the City Council
in this matter.
C. That said Planned Unit Development, together with
the provisions for its design and improvement and subject to the

conditions of this resolution, is consistent with all applicable
general and specific plans of the City of Carlsbad.
D. That Planned Unit Development (PUD-8(A)) is hereby
approved subject to all applicable requirements of the Carlsbad
Municipal Code and to the satisfaction of the conditions
contained in Planning Commission Resolution No. 2230, dated
December 14, 1983, marked Exhibit A, attached hereto and made a
part hereof.
PASSED, APPROVED, AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California, on the
17th day of JanuarY , 1984 by the following vote, to
wit:

A RESOLUTION OF THE PLANNING COMMISSION OF THE
APPROVAL OF AN AMENDMENT TO A PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED
APPLICANT: McKELLAR DEVELOPMENT CASE NO: PUD-8 (A)
CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
ADJACENT- TO MONROE AVENUE AND HOSP WAY.
WHEREAS, a verified application for certain property, to
tit:
Lots 36 - 143 of Carlsbad Tract 77-2, according to Map
10088 filed May 12, 1981,
ias been filed with the City of Carlsbad, and referred to the
'lanning Commission: and
WHEREAS, said verified application constitutes a request
PS provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 14th day of
lecember, 1983, hold a duly noticed public hearing as prescribed by
Law, to consider said request; and
WHEREAS, at said public hearing, upon hearing and
=onsidering all testimony and arguments, if any, of all persons
jesiring to be heard, said Commission considered all factors
relating to the Tentative Tract Map and Planned Unit Development;
and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on evidence presented at the public hearing, the Commission recommends APPROVAL of PUD-8(A), based on the
following findings and subject to the following conditions:
Findings:
1) The proposed project is consistent with the City's Planned
Development Ordinance and also complies with the Design Guidelines Manual.

The proposed project is compatible with the surrounding future
land uses since surrounding properties are designated for
residential development on the general plan.
The proposed project will be compatible with the existing duplexes built in the first phase of CT 77-2 for the reasons stated in the staff report.
This project has already been considered in conjunction with
a previously certified environmental document and a Notice of prior Environmental Compliance was issued November 18, 1983.
Conditions:
Approval is granted for PUD-8(A), as shown on Exhibits "A" - "I", dated December 14, 1983, incorporated by reference and
on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these
conditions.
This project is approved upon the express condition that
building permits will not be issued for development of the
subject property unless the City Engineer determines that
sewer facilities are available at the time of application for
such sewer permits and will continue to be available until
time of occupancy.
.This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for
payment of said fee, a copy of that agreement, dated October 10, 1983, is on file with the City Clerk and incorporated
herein by reference. If said fee is not paid as promised,
this application will not be consistent with the General Plan
and approval for this project shall be void.
Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable Citj ordinances in effect at time of building permit issuance.
The applicant shall prepare a reproducible mylar of the final
site plan incorporating the conditions contained herein. Saic
site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits.
The applicant shall prepare a detailed landscape and irriga-
tion plan which shall be submitted to and approved by the Lanc Use Planning Manager prior to the issuance of building permits.

A 500' scale map of the subdivision has been submitted to
the Land Use Planning Manager. Any changes to the map created by this amendment shall require the submittal of a new 500' scale map.
All parking lot trees shall be a minimum of 15 gallons in size..
All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris.
Any signs proposed for this development shall be designed in
conformance with the City's Sign Ordinance and shall require
review and approval of the Land Use Planning Manager prior to
installation of such signs.
All roof appurtenances, including air conditioners, shall be
architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Land Use Planning Manager and Building and Planning Director.
The project shall provide bus stop facilities at locations
subject to the satisfaction of the North County Transit Dis-
trict. Said facilities shall at a minimum include a bench, free from advertising, and a pole for the bus stop sign. The bench and pole shall be designed in a manner so as to not detract from the basic architectural theme of the project and
said design shall be subject to the approval of the Land Use Planning Manager and North County Transit District.
All garages with entries facing a private driveway shall
maintain either a 5 foot to 8 foot setback or a 20 foot
setback from the edge of pavement. Garages with entries facing a sidewalk shall maintain at least a 20 foot setback from the edge of the sidewalk.
Recreational vehicle storage shall be provided per section
21.45.090 of the Carlsbad Municipal Code to the satisfaction
of the Land Use Planning Manager.
Fire Department
15) All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "NO Parking/Fire Lane Tow Away Zone'' pursuant to Section 17.04.040, Carlsbad Municipal
Code.
16) Fire retardant roofs shall be required on all structures.

Parks and Recreation
A walkway system shall be constructed within this pro-ect and
the adjacent city park to the satisfaction of the Director of
Parks and Recreation and the Land Use Planning Manager. The
delineation of this walkway system will be designated by the
Director of Parks and Recreation. This walkway system shall
have a four foot width, be constructed of four inches of
decomposed granite material and have redwood header boards to
contain the decomposed granite. These improvements may be
bonded for, subject to the approval of the Director of Parks
and Recreation.
Landscape improvements shall be provided to the east and west
of the parking area located off Wickham Way. These
improvements shall include a manual irrigation system with pop-up heads. The landscaping materials shall be native
drought tolerant shrubbery, including Sugar Bush, Lemonade
Berry (Rhus varieties) and various Lantana varieties. These
improvements may be bonded for, subject to the approval of
the Director of Parks and Recreation.
The applicant shall construct a six foot vinyl coated chain-
link fence with wooden headers along the edge (3 feet back) of the bluff adjacent to the city park. This fence shall be constructed from the east side of the hammerhead just east of the recreation area to lot 54, then along lots 54 through 57 and 84 through 88 to the satisfaction of the Director of Parks and Recreation. All other fences constructed as part of this project shall be compatible with those fences constructed as part of Phase I.
