A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
CALIFORNIA, APPROVING AN AMENDMENT TO CONDITION #15 OF
CONDITIONAL USE PERMIT CUP-217 PROVIDING AGE RESTRICTIONS
ON A SENIOR CITIZEN HOUSING PROJECT ON PROPERTY LOCATED AT
3363 TYLER STREET.
APPLICANT: CITY OF CARLSBAD - SWEATTE
CASE NO.: CUP-217(A)
WHEREAS, a verified application has been filed with the
ity of Carlsbad and referred to the City Council; and
WHEREAS, said verified application constitutes a request as
rovided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the City Council of the City of Carlsbad, on
snuary 17, 1984, held a public hearing to consider the
xommendations and heard all persons interested in or opposed to
3nditional Use Permit (CUP-217(A)); and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
ity of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That based on the evidence presented at the public
earing, the Council APPROVES CUP-217(A), based on the following
indings and subject to the following conditions:

) The proposed project will not alter the original project and is necessary to ensure compatibility with policies of the
Carlsbad School Board.
There will be no significant impacts created by the amendment as the project has been subject to previous environmental review. A statement of prior compliance was issued by the
Land Use Planning Manager on December 20, 1983.

I Approval is granted for CUP-217(A), as shown on Exhibit "X",
attached and incorporated herein, dated, January 17, 1984.
I All conditions other than condition number 15 of City Council Resolution No. 6985 approving CUP-217 shall remain in effect and are incorporated herein by reference. 2

Condition 15 as amended shall be as follows:
15) The following requirements shall be made part of the lease
agreement executed for all rentals at this project:

The minimum age of at least one occupant of each unit shall be sixty-two years of age.
There shall be no more than two people residing in any
one-bedroom unit.
There will be no more than three people residing in any two-bedroom apartment, and that two of the three will be over sixty-two, and the third person over thirty-five,
except that if the third person is a live-in nurse or attendant required for medical reasons. Two-thirds of the units shall be limited to occupancy by tenants who do not have automobiles. Prior to any rentals the lease shall be summarized to the City for approval. The minimum age for any occupant of any unit shall be twenty-five years of age.
