(hereinafter referred to as the "Assessment District"); and,
WHEREAS, at this time the public hearing on said Assessment District
has been opened and continued, and this legislative body is now desirous to
consider a proposed alternate to the proposed works of improvement for said
Assessment District.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That the public interest and convenience requires, and it
is the intention of this City Council, to consider an alternate proposal
for the works of improvement in the Assessment District, as said alternate
proposal for the works of improvement is set forth in the attached,
referenced and incorporated Exhibit "At1.
SECTION 3. NOTICE IS HEREBY GIVEN THAT THE ORIGINAL HEARING ON THIS
ASSESSMENT DISTRICT HAS BEEN CONTINUED TO TUESDAY, THE 19TH DAY OF MARCH,
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION
TO CONSIDER ALTERNATE IMPROVEMENTS IN A SPECIAL
ASSESSMENT DISTRICT. e---*-

WHEREAS, the City Council of the City of Carlsbad, California, has
COUNCIL WILL CONSIDER ANY PROTESTS OR OBJECTIONS TO THE ORIGINAL PROPOSED
previously initiated proceedings and set a public hearing pursuant to the
terms and provisions of the "Special Assessment Investigation, Limitation
11 and Majority Protest Act of 1931", being Division 4 of the Streets and I
Highways Code of the State of California, for an assessment district
designated as
ASSESSMENT DISTRICT NO. 83-2

1985, AT THE HOUR OF 6:OO P.M., IN THE REGULAR MEETING PLACE OF THE CITY
26 11 COUNCIL, BEING THE COUNCIL CHAMBERS, CITY HALL, AND AT SAID TIME THE CITY I

WORKS OF IMPROVEMENT AS WELL AS ANY PROPOSED CHANGES AND MODIFICATIONS BY
REASON OF THE PROPOSED ALTERNATE WORKS OF IMPROVEMENT, AS SET FORTH IN THIS
RESOLUTION. ANY OBJECTIONS SHOULD BE IN WRITING AND FILED WITH THE CITY
CLERK BY ANY INTERESTED PERSON AT ANY TIME NOT LATER THAN THE TIME SET FOR
THE CONTINUATION OF THE PUBIC HEARING.
SECTION 4. That the City Clerk is hereby directed to immediately mail
copies of this Resolution, upon its adoption, to all property owners owning
property within the boundaries of the Assessment District. Said mailing
shall be to the owner or owners of said property as said names and
addresses appear on the last equalized assessment roll or as known to the
City Clerk.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
City Council held on the - 12th day of ,wch , 1985 by the following

PROPOSED ALTERNATE ---- WORKS- OF IMPROVEMENT
I. A description of the proposed alternate works of improvement is as
follows:
Construction of certain street improvements in James Drive
between Oak Avenue and Basswood Avenue, including but not limited
to, grading, paving, curb and gutter, drainage facilities, water
and sewer improvements, public utility facilities, and
acquisition of rights-of-way, where necessary, together with
appurtenances and appurtenant work, to serve the parcels within
the boundaries of Assessment District No. 83-2 (James
Drive).
11. The proposed alternate works of improvement will cause the following
changes and modifications in the assessments:
