RESOLUTION NO. 8102
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA APPROVING THE
SETTLEMENT OF TWO LAWSUITS:
GARCIA v CITY OF CARLSBAD CASE NO. N23456
CRUZ V CITY OF CARLSBAD CASE NO. N24939
The City Council of the City of Carlsbad resolves as follows:
1) The expenditure of $55,000 from account No. 771-19-
10-2872 for the settlement of Garcia v City of Carlsbad and
Cruz v City of Carlsbad is approved and ratified.
2) The City Attorney is authorized to execute all
documents necessary to effect the settlement and dismissal of
these lawsuits.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California held on the
2nd day of July , 1985 by the following vote to
wit:

from age 12 to age 13 $750 / mo.
Monthly payments will increase each year on the child’s
birthday, thus the final year, from age 22 to age 23 tht
monthly payments will be $1250.
Lump sum payments:
$25,000 Upon execution of settlement
documents.
$10,000 On 18th birthday
$15,000 On 20th birthday
$25,000 On 23rd birthday
Medical Insurance Annuity
$70. per month until 21st birthday to be increased at a
rate of 3% per annum.

Paid to Bonatacio and Mary Cruz:
$15,000 single lump sum payment.
They will also be named as the residual beneficiary
under the annuity for Rayna Garcia so that if she dies, the
grandparents will have the reversenary interest.
Previously paid by subdivider to uninsured motorist
carrier and insurance carrier for other vehicle involved in
collision-$10,000.
