RESOLUTION NO. 8118
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE COLLECTION OF
AN INTERIM TRAFFIC IMPACT FEE FOR THE LA COSTA AREA.
WHEREAS, the City Council has, by Resolution No. 8117 , authorized
the City Manager to undertake a Traffic Impact Fee Study; and
WHEREAS, said study is to be completed within six months of the date of
passage of said Resolution No. 8117 ; and
WHEREAS, pending the outcome of the said study it is necessary and
desirable that an interim Traffic Impact Fee be collected.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. Effective this date, an Interim Traffic Impact Fee shall be collected
from all new land developments in the area shown on Exhibit f'3tq which is made
a part hereof.
3. The amount of the fee to be collected shall be based on a rate of
$25.00 per daily traffic trip generated by such development.
4. The amount of traffic trips generated shall be taken from the
publication "SANDAG, Trip Generation for the San Diego Areaqf according to the
latest available revision.
5. That all development shall be subject to a condition of development
reading substantially as follows:
Developer shall, prior to final map approval, enter into an
agreement with the City for the developer to pay a traffic impact
fee for the developer's share of mitigating anticipated future
traffic problems at and near the intersection of El Camino Real
and La Costa Avenue. The interim fees to be collected, at the
time of building permit issuance, shall not exceed $25.00 per
daily traffic trip to be generated. The amount of such fees shall
be determined by the City Council, based on an area traffic impact
study to be undertaken by the City and concluded within six months
after approval of applicant's tentative tract map.

6. That records of any amounts collected shall be maintained in separate
accounts so that refunds can be made in the event the fee determined by a
Traffic Impact Fee Study is less than the interim fee.
