A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING
AN EASEMENT OVER A PORTION OF FOREST AVENUE AND HIGHLAND DRIVE -
AYES: Council Members Casler, Lewis, Kulchin, Chick and
Pettine
WHEREAS, that easement previously dedicated contains no
public facilities or appurtenances, and provides no useable
access to the adjoining property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That an easement for all utility purposes is
excepted from this vacation.
3. That, pursuant to Section 8334 of Chapter 1050 of
the California Streets and Highways Code, said easement
referenced above, be summarily vacated,
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 17th- day of September ,
1985 by the following vote, to wit:

That portion of the Southeast Quarter of the Southwest Quarter of Section
31, Township 11 South, Range 4 West, San Bernardino Meridian, in the City
of Carlsbad, County of San Diego, State of California according to Official
Plat thereof described as follows:
Beginning at the Southeast corner of Lot 1 of Cedar Hills Addition, accord-
ing to Map No. 532 thereof, filed in the Office of the County Recorder of
San Diego County, April 25, 1888; thence along the southerly line of said
Lot 1, South 89'58'00" West 123.52 feet; thence leaving said southerly line,
South 00'05'00'' East 30.00 feet to a line parallel with the southerly line
of said Lot 1 and a distant 30.00 feet southerly therefrom; thence along
said parallel line, North 89'58'00" East 76.64 feet an intersection with the
arc of that 60.00 foot radius curve concave southwesterly described in deed
to the County of San Diego recorded May 13, 1936 in Book 517, Page 138 of
Official Records of said county and as shown on Road Survey No. 690, the
center of said arc bears South 33'31'26" West from said intersection and
said intersection being the TRUE POINT OF BEGINNING; thence continuing
along said parallel line, North 89'58'00'' East 1.84 feet to the beginning
of a tangent 20.00 foot radius curve concave southwesterly; thence south-
easterly along the arc of said curve through a central angle of 90'00'48''
an arc length of 31.42 feet to a line parallel with the easterly line of
the Southeast Quarter of the Southwest Quarter of said Section 31 and a distant
25.00 feet westerly therefrom; thence tangent to said 20.00 foot radius
curve and along said parallel line, South 00'01'12" East 6.03 feet to an
intersection with the aforementioned 60.00 foot radius curve concave south-
westerly as shown on Road Survey No. 690; thence northwesterly along the
arc of said 60.00 foot radius curve through a central angle of 32'53'59''
an arc length of 34.45 feet to the TRUE POINT OF BEGIKNING.
