RESOLUTION NO. 8219
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A 112 UNIT TENTATIVE TRACT MAP (CT 85-19) AND PLANNED UNIT DEVELOPMENT (PUD-87) ON 28 ACRES ON PROPERTY GENERALLY LOCATED BETWEEN MELROSE AVENUA AND
RANCHO SANTA FE ROAD, EAST AND SOUTH OF ALGA ROAD.
APPLICANT: THE MEADOWLANDS
CASE NO: CT 85-19/PUD-87.
WHEREAS, on September 11, 1985, the Carlsbad Planning
Commission adopted Resolution No. 2488 recommending to the City
Council that Tentative Tract Map (CT 85-19) and Planned Unit
Development (PUD-87) be approved; and
WHEREAS, the City Council of the City of Carlsbad, on
October 1, 1985 held a public hearing to consider the
recommendations- .and heard all persons. interested 'in or opposed tc
Tentative Tract Map (CT 85-19) and Planned Unit Development (PUD.
-,
87); and
WHEREAS, said Tentative Tract Map and Planned Unit
Development have been declared to have a nonsignificant impact 01
the environment and a Negative Declaration was issued by the Lanc
Use Planning Manager and approved by the City Council on October
1, 1985 in compliance with the requirements of the City of
Carlsbad Environmental Protection Ordinance of 1980 and the
California Environmental Quality Act.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission in
Resolution No. 2488 constitute the findings of the City Council
in this matter.

C. That said Tentative Tract Map, together with the
provisions for its design and improvement and subject to the
conditions of this resolution, is consistent with all applicable
general and specific plans of the City of Carlsbad.
D, That Tentative Tract Map CT 85-19 and Planned Unit
Development PUD-87 are hereby approved subject to all applicable
requirements of the Carlsbad Municipal Code and to the
satisfaction of the conditions contained in Planning Commission
Resolution No. 2488 dated September 11, 1985 marked Exhibit A anc
as modified on Exhibit B attached hereto and made a part hereof.

APPROVAL OF A 112 UNIT TENTATIVE MAP AND PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY
LOCATED BETWEEN MELROSE AVENUE AND RANCHO SANTA
APPLICANT: THE MEADOWLANDS

WHEREAS, a verified application for certain property, to
vit:
A portion of the south half of Section 19, and a portion of the northeast quarter of Section 30, T12S, R3W, San Bernardino Base Meridian in the County of San Diego,
ias been filed with the City of Carlsbad, and referred to the

WHEREAS, said verified application constitutes a request <

WHEREAS, the Planning Commission did, on the 11th day of

WHEREAS, at said public hearing, upon hearing and

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning

The project is consistent with the City's General Plan since
the proposed density of 4.0 du's/acre is slightly below the
density range of 4.1 - 9.0 du's/acre specified for the site as indicated on the Land Use Element of the General Plan.
The site is physically suitable for the type and density of
the development since the site is adequate in size and shape
to accommodate residential development at the density pro- posed.
The project is consistent with all City public facility pol- icies and ordinances since:
The Planning Commission has, by inclusion of an
appropriate condition to this project, ensured that the
final map will not be approved unless the City Council
finds that sewer service is available to serve the
project. In addition, the Planning Commission has added a
condition that a note shall be placed on the final map
that building permits may not be issued for the project
unless the City Engineer determines that sewer service is
available, and building cannot occur within the project
unless sewer service remains available, and the Planning
Commission is satisfied that the requirements of the
Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this
project .
The San Marcos School District has written a letter, dated
July 2, 1985, stating that school facilities will be available to this project.
Park-in-lieu fees are required as a condition of ap-
proval .
All necessary public improvements have been provided or will be required as conditions of approval.
The applicant has agreed and is required by the inclusion
of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee
will enable this body to find that public facilities will
be available concurrent with need as required by the general plan.
Assurances have been given that adequate sewer for the
project will be provided by the City of Carlsbad.
The proposed project is consistent with the City's Planned Development Ordinance and also complies with the Design Guidelines Manual.

5) The proposed project is compatible with the surrounding future
land uses since surrounding properties are designated for residential development on the General Plan.
6) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the Land Use Planning Manager on July 27, 1985 and approved by the
Planning Commission on September 11, 1985.
Conditions:
Approval is granted for CT 85-19/PUD-87, as shown on
Exhibits "A" - "L" , dated August 1, 1985, incorporated by
reference and on file in the Land Use Planning Office.
Development shall occur substantially as shown unless
otherwise noted in these conditions.
This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision.
This project is approved upon the express condition that
building permits will not be issued for development of the
subject property unless the City Engineer determines that sewer facilities are available at the time of application for
such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final
map ,
This project is 'approved upon the express condition that the

Land Use Planning Conditions:
The applicant shall prepare a reproducible mylar of the final
site plan incorporating the conditions contained herein. site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits.
Said
The applicant shall establish a homeowner's association and corresponding covenants, conditions and restrictions. Said
CC&R's shall be submitted to and approved by the Land Use
Planning Manager prior to final map approval.
The applicant shall prepare a detailed landscape and irriga-
tion plan which shall be submitted to and approved by the Land
Use Planning Manager prior to the issuance of building permits.
A 500' scale map of the subdivision shall be submitted to the
Land Use Planning Manager prior to the recordation of the final map. Said map shall show all lots and streets within and adjacent to the project.
All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris.
Any signs proposed for this development shall be designed in
conformance with the City's Sign Ordinance and shall require
review and approval of the Land Use Planning Manager prior to
installation of such signs.
All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant
to Building Department Policy No. 80-6, to the satisfaction of
the Land Use Planning Manager and Building and Planning Director.
The applicant shall submit a street name list consistent with
the City's street name policy subject to the Land Use Planning Manager ' s approval prior to final map approval.
The project shall provide bus stop facilities at locations
subject to the satisfaction of the North County Transit Dis- trict. Said facilities shall at a minimum include a bench,. free from advertising, and a pole for the bus stop sign. The bench and pole shall be designed in a manner so as to not
detract from the basic architectural theme of the project and said design shall be subject to the approval of the Land Use
Planning Manager and North County Transit District.
The developer shall display a current Zoning and Land Use Map
in the sales office at all times, and/or suitable alternative
to the satisfaction of the Land Use Planning Manager.

All sales maps that are distributed or made av ilable to the
public shall include but not be limited to trails, future and
existing schools, parks, and streets.
Building identification and/or addresses shall be placed on
all new and existing buildings so as to be plainly visible
from the street or access road: color of identification and/or
addresses shall contrast to their background color.
Prior to occupancy of any units, the applicant shall construct
a directory sign at the entrance to the project. The design of this sign shall be approved by the Land Use Planning
Manager.
If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof,
imposed by this approval or imposed by law on this project are
challenged, this approval shall be suspended as provided in
Government Code Section 65913.5. If any such condition is
determined to be invalid this approval shall be invalid unless
the City Council determines that the project without the
condition complies with all requirements of law.
Prior to issuance of any building permits, the applicant
shall submit a detailed fencing plan for the approval of the
Land Use Planning Manager. At a minimum, solid wood or block
fences shall be placed between units along side property lines
from the front of the dwelling unit to the rear property
lines. Said fences shall be installed prior to occupancy of the units.
Berming and a meandering, stuccoed, decorative wall shall be constructed along Melrose Avenue as stipulated in the
mitigation measures of Acoustical Analysis 024-85, submitted
for this project. Architectural design of the decorative wall shall be approved by the Land Use Planning Manager prior
to construction of the wall.
Heavy landscaping shall be planted along the northern and
eastern boundaries of the project to form a dense landscaped
buffer between the proposed project and adjacent properties. Landscaping shall be approved by the Land Use Planning
Manager.
Play equipment proposed for the tot lots shall be approved by
the land Use Planning Manager.
The CCGrR's shall contain a provision prohibiting the parking or storage of recreational vehicles onsite. In addition, the applicant shall participate in the design and location of a permanent RV storage facility in the La Costa area.

Prior to issuance of a building permit, the Building Director shall review the architectural plans to ensure compliance
with the State of California interior noise standard of 45
CNEL. At that time, any additional measures (thicker glazing, sound absorption material, or shielding of vents) to
further attenuate the noise to an acceptable level shall be
required.

Planning Manager prior to the issuance of any building
permits to ensure that driveways are located to maximize guest parking.

Avenue shall be maintained by the homeowner's association and
shall be reflected as a maintenance easement on the final
map.

12) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site .
13) The grading for this project is defined as "controlled grad- ing" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site
inspection and testing to ensure compliance of the work with
the approved grading plan, submit required reports to the City
Engineer and verify compliance with Chapter 11 .06 of the Carlsbad Municipal Code.
No grading shall occur outside the limits of the subdivision unless a letter of permission is obtained from the owners of
the affected properties.

Prior to hauling dirt or construction materials to any
proposed construction site within this project the developer
shall submit to and receive approval from the City Engineer
for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose
with regards to the hauling operation.
The developer shall exercise special care during the
construction phase of this project to prevent any offsite siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention
basins of type, size and location as approved by the City
Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to
the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities,
slope erosion control measures and other methods required or
approved by the City Engineer. The developer shall maintain . the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee
their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to the City
E ng ineer .
The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacent
property prior to approval of the final map for this project.
Additional drainage easements and drainage structures shall be
provided or installed as may be required by the County
Department of Sanitation and Flood Control or the City Engi- neer.
The developer shall pay the current local drainage area fee
prior to approval of the final map for this project or shall construct drainage systems in conformance with the Master
Drainage Plan and City of Carlsbad Standards as required by the City Engineer.
The developer shall make an offer of dedication to the City
for all public streets and easements required by these conditions or shown on the tentative map. The offer shall be
made by a Certificate on the Final Map for this project. All
land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. Streets that are already public are not required to be
rededicated.
Melrose Avenue shall be dedicated and constructed by the developer along the subdivision frontage based on a centerline to right-of-way width of 63 feet and in conformance with City of Carlsbad Standards.

Rancho Santa Fe Road shall be dedicated and constructed by the
developer along the subdivision frontage based on a centerline to right-of-way width of 51 feet and in conformance with City of Carlsbad Standa.rds. An offer to dedicate a 63 foot right- of-way shall be made on the final map.
Streets C, D, E, F, G, and H shall be dedicated and
constructed by the developer based on a right-of-way width of
56 feet and Street B shall be dedicated based on a 60 foot
right-of-way width and Street A shall be dedicated on an 80
foot right-of-way width with necessary transitions from Alga
Road west of Melrose Avenue and in conformance with City of
Carlsbad Standards .
Meadowlark Ranch Road shall be dedicated by the developer
along the subdivision frontage based on a centerline to right- of-way width of 30 feet and in conformance with City of
Carlsbad Standards and from this subdivision to Rancho Santa
Fe Road. The applicant shall obtain necessary right-of-way . to complete improvements of Meadowlark Ranch Road (60 foot
wide standard width) from this subdivision to Rancho Santa Fe Road prior to final map approval of Phase 11.
Direct access rights for all lots abutting Rancho Santa Fe
Road and Melrose Avenue shall be waived on the final map. The
following lots shall waive access rights to Street B on the
final map: Lots 94, 116, 91, 85, 67 and 58.
Plans, specifications, and supporting documents for all
improvements shall be prepared to the satisfaction of the City Engineer. Prior to approval of the final map for each phase, the Subdivider shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the tentative map and the following improvements to City Standards to the satisfaction of the City Engineer:
All public streets and utilities as listed herein.
Unless a standard variance has been issued, no variance from
City Standards is authorized by virtue of approval of this
tentative map. The alignment of Rancho Santa Fe Road is
established as shown on the tentative map.
The developer shall comply with all the rules, regulations and
design requirements of the respective sewer and water agencies regarding services to the project.
This development proposes three phases of construction. The
following improvements shall be constructed prior to
occupancy of any unit within the specified phase, with the
exception of Meadowlark Ranch Road which shall be constructed
(including necessary transitions on Rancho Santa Fe Road)
prior to occupancy of the 71st unit.

out of numerical sequence with the approved phasing as shown on the tentative map all conditions required of the preceding phases shall be completed unless otherwise approved by the
City Engineer and the Land Use Planning Manager.
The applicant shall agree to utilize reclaimed water
pursuant to the agreement between Daon Corporation and the
San Marcos County Water District dated June 1, 1985 which is Exhibit "2" to the Termination Agreement between Rancho La Costa, Inc. and the San Marcos County Water District
dated June 1, 1985.

Reclaimed water use and water transmission and distribution facilities shall be designed and constructed at the applicant's sole expense pursuant to the requirements of the
San Marcos County Water District.
The reclaimed water irrigation system shall be maintained and
operated consistent with the requirements of the San Marcos County Water District and the City of Carlsbad under a contractual agreement with the Homeowner's Association that is to give the district total assurance that they would always have the ability to discharge the effluent.
Irrigation systems to accommodate future reclaimed water shall
be designed consistent with Title 17 of the California State
Administration Code. Offsite future reclaimed water distribution systems should be anticipated by the installatior of adequately sized sleeves at crossing points to minimize street excavation.
The City Council has determined that in order to accommodate the traffic on Rancho Santa Fe Road, the developer of projecti in this area must be responsible for the improvement of Ranchc Santa Fe Road from La Costa Avenue to the existing Melrose Drive intersection. Prior to final map approval the develope1
shall submit a proposal satisfactory to the City Council for such improvements. The proposal shall be based on an independent traffic analysis accomplished to the satisfaction of the City Engineer. The proposal shall include a time schedule and financing plan for the improvements which may include an assessment district, developer financing, or some alternative acceptable to the City Council. The construction and improvements must be assured either by confirmation of thc assessment district secured subdivision improvement agreement,
or otherwise guaranteed to the satisfaction of the City Council prior to final map approval.
The right-turn access on Melrose Avenue is sp.ecifically not approved. Prior to occupancy of the 71st unit, the applicant shall have completed full improvements to Meadowlark Ranch
Road and necessary improvements as required by the City Engineer to the intersection of Meadowlark Ranch Road and Rancho Santa Fe Road. The timing of the above improvements
may be modified by the City Engineer.
All concrete terrace drains shall be maintained by the
homeowner's association (if on commonly owned property) or tht individual property owner (if on an individually owned lot).
An appropriately worded statement clearly identifying the
responsibility shall be placed in the CC&R's.
The Subdivider shall provide separate sewer, water, gas, and
electric services with meters to each of the units.

Some improvements shown on the Tentative Map and/or required
by these conditions are located offsite on property which neither the City nor the subdivider has sufficient title or interest to permit the improvements to be made without
acquistion of title or interest. to Section 20.16.095 of the Carlsbad Municipal Code.

The developer shall provide the City with a reproducible mylai
copy of the tentative map as approved by the Planning Commission. The tentative map shall reflect the conditions oJ approval by the City. The map shall be submitted to the City Engineer prior to improvement plan submittal and shall be 24" x 36" in size and of a quality and material satisfactory to

This subdivision contains a remainder parcel. No building
permit shall be issued for this parcel until it is further
subdivided pursuant to the provisions of Title 20 of the
Carlsbad Municipal Code. This note shall be placed on the final map. Access rights to this parcel shall be waived along
proposed Rancho Santa Fe Road and Melrose Avenue.
Developer shall, prior to final map approval, enter into an
agreement with the City for the developer to pay a traffic
impact fee for the developer's share of mitigating anticipated future traffic problems at and near the intersection of El
Camino Real and Olivenhain Road, and at and near the intersection of El Camino Real and La Costa Avenue. The interim fees to be collected, at the time of building permit
issuance, shall not exceed $250 per single family housing
unit, nor $200 per multiple family housing unit. The amount of such fees shall be determined by the City Council based on
an area traffic impact study to be undertaken by the City and concluded within six months after approval of applicant's tentative tract map.
Fire Conditions:
Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal.
The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval.
An all-weather access road shall be maintained throughout construction.
All required fire hydrants, water mains and appurtenances
shall be operational prior to combustible building materials
being located on the project site.
Brush clearance shall be maintained according to the specifications contained in the City of Carlsbad Landscape Guidelines Manual.
All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approva:

Prior to approval of the final map, the developer shall provide for the construction of emergency access at the end of the
cul-de-sac and existing Meadowlark Ranch Road.
The intersection spacing of the access, as
shown on Exhibit A, dated August 1, 1985, revised September 27, 1985, is approved
subject to final design approval of the City Engineer.
Specific improvements of Rancho Santa Fe Road shall be in accordance with current City standards, as shown on Exhibit A, dated August 1, 1985, revised September 27, 1985, and subject to approval of the City Engineer.
The remainder parcel, as shown on the
tentative map, is specifically not approved. All reference to this "remainder parcel"
shall mean "Lot A, a non-buildable site." Development of this lot shall require
