RESOLUTION NO. 8370
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, COVERING PRELIMINARY DETERMINATION AND ORDERING THE PREPARATION OF A REPORT ON SAID IMPROVEMENT
WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD,
CALIFORNIA, is contemplating the construction of certain public
works of improvement under proceedings conducted pursuant to the
"Municipal Improvement Act of 1913", being Division 12 of the
Streets and Highways Code of the State of California, in a special
assessment district known and designated as
(PALOMAR AIRPORT ROAD) ASSESSMENT DISTRICT NO. 86-1
(hereinafter referred to as the "Assessment District").
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That certain public works of improvement, toge-
ther with appurtenances and appurtenant work, including acquisi-
tion where necessary, are proposed to be done and made within the
boundaries of the Assessment District. In connection therewith,
it is found and determined as follows:
A. That the specific nature of the proposed
works of improvement consists of all the work as shown on the

proposed boundary map, as previously approved for this Assessment
District.

B. That the boundaries of the Assessment
District and the lands and properties within the Assessment
District proposed to be assessed to pay the costs and expenses of
said proposed works of improvement are as shown upon a map of the

Assessment District, which map has been heretofore approved and is
on file with the transcript of these proceedings. Said map shall
govern for all details as to the extent of the Assessment
District.
SECTION 3. That the statute under which it is proposed to
conduct proceedings is the "Municipal Improvement Act of 1913",
being Division 12 of the Streets and Highways Code of the State of
California, with bonds proposed to be issued as authorized by the
"Improvement Bond Act of 1915", being Division 10 of said Code.
SECTION 4. That this proposed improvement is referred to the
ENGINEER OF WORK, who is hereby appointed to procure all necessary
information to prepare a report on the proposed improvement in the
manner and form provided for in Division 4 of the Streets and
Highways Code of the State of California, the "Special Assessment
Investigation, Limitation and Majority Protest Act of 1931".
SECTION 5. That this Resolution and the Report as ordered
herein are pursuant to the provisions of said Division 4, and said
Report shall have attached to it a copy of this Resolution upon
its adoption.
SECTION 6. That the works of improvement as proposed under
these proceedings generally consist of the construction and
installation of certain half or full width street improvements in
PALOMAR AIRPORT ROAD from INTERSTATE 5 running Easterly approxi-
mately 8,000 feet, including erosion control, underground communi-
cation, gas and power facilities, water lines and drainage
improvements, together with appurtenances, including the acquisi-
tion of rights-of-way where necessary to accomplish the referenced
improvements.

SECTION 7. That this City Council does not, at this time,
intend to make any contribution or appropriation of funds toward
the costs and expenses of the works of improvement as provided
under these proceedings, and all costs and expenses relating
thereto shall be financed through special assessments levied upon
benefited lands and properties within the boundaries of the
Assessment District in the manner and form as established by law.
PASSED, APPROVED and ADOPTED at a regular meeting of the City
Council held on the 28th day of , January , 1986, by the
following vote, to wit:
