RESOLUTION NO. 8508 ----
A RESOLUTIObl IN SUPPORT OF
SENATE BILL 1694 w (BERGESON)
WHEREAS, Senator Bergeson has introduced 53 1694, ameslding Section 831.2 of
the Goverment Code, relating to public lidility; and
WHEREAS, it is 0-f' vitd public interest that the public be permitted use OS
unimproved public property for recreational purposes; and
WEREAS, public entities will be forced to close or restrict the use of
their property due to the expense of insuring against, defending, ard paying
claims for iqfuries sustained by persons usiq such property; and
WHEREAS, public entities sbuld not lose their immwity because they have
taken steps to protect the safety and welfare OF timse usirg public property;

WHEREAS, a court, in the case of Gonzales v City of San Diego, has
detemind that the prwision of lifeguard service eliminates a govermental
agency's traditional immunity for accidents occurring on public property in its
natural state.
NOW, THEREFORE, E IT RESOLVED that the City Council of the City of Carlsbac
supports SB 1694 - Bergeson - and urges the California State Legislature to
adopt that legislation as quickly as possible to restore the lorgstanding
immunity for goverrmentdl agencies related to public property in its natural
condition so that lifeguard service and other public safety personnel will
continue to be provided for the benefit of the public.
