A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF
CARLSBAD AND THE COUNTY OF SAN DIEGO FOR ANIMAL CONTROL SERVICES.
WHEREAS, the City desires to contract with the County of San
Diego for the performance within its boundaries of certain animal
control services; and
WHEREAS, the City is authorized to enter into this agreement
pursuant to Government Code Section 51300 et seq.; and
WHEREAS, the County of San Diego is willing and able to
perform such services on certain terms and conditions set forth
in the proposed "Agreement Animal Control Services"; and
WHEREAS, the performance of such services by the County of
San Diego will eliminate the necessity of City providing
dup 1 icat e s services ;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. The above recitations are true and correct.
2. The agreement between the City of Carlsbad and the County
of San Diego for animal control services attached hereto as
Exhibit "A" is hereby approved.

3. The City Manager of the City of Carlsbad is hereby
authorized and directed to execute said agreement for and
on behalf of the City of Carlsbad.

AGREEMENT
ANIMAL CONTROL SERVICES
THIS AGREEMENT, dated for purposes of reference only,
9 j9-9 is made by and between the County of
SAN DIEGO, hereinafter referred to as llCountyll, and the CITY OF
CARLSBAD , hereinafter referred to as llCityl'.
WITNESSETH:
WHEREAS, The City desires to contract with the County for the
performance within' its boundaries of the hereinafter described
animal control services; and
WHEREAS, The County of San Diego is willing and able to render
such services on the terms and conditions hereinafter set forth;
and
WHEREAS, this contract is authorized and provided for by the
provisions of Section 500.4 of Article V of the Charter of the
County of San Diego and Sections 51300 et seq. of the Government
Code.
NOW THEREFORE, IT IS AGREED:
1. The County agrees, through the Director of Animal ..
Control of the County of San Diego, to provide animal control
services within the corporate limits of City to the extent and in
the manner hereinafter set forth.
Such services shall be defined as those duties and
functions of the type coming within the jurisdiction of and
customarily rendered by the Department of Animal Control of the
County of San Diego under the Charter of said County and the
statutes of the State.
The level of service provided to City shall be the same
basic level of service that is and shall be provided during the
term of this agreement for unincorporated areas of the County of
San Diego by the Director of Animal Control. The Director of
Animal Control of the County has discretion in determining how the
level of service of this contract shall be performed by the
County.
The Department of Animal Control's services shall be as
follows, unless notified in writing of any changes:
For Shelter Management Services, the County will:
a. operate, twenty-four (24) hours-day, seven (7)
days per week, a holding shelter for the
feeding and care of City's lost, abandoned and
impounded animals
b. provide public access to shelters during
established business hours, for adoption
services, humane disposal of animals,
abatement, impound and vicious dog hearings
c. sponsor rabies vaccination clinics;
For Field Services, the County will:
a. rescue City's injured animals and reptiles,
b. impound City's stray animals and reptiles,

c. quarantine City's biter animals,
d. investigate City's reports of vicious dogs;
e. respond to requests for service, and when
required, issue citations within City's
jurisdiction, enfo-rcing local and state laws,
f. investigate City's humane cases,
g. return City's lost dogs in the field, as
po ss i b le,
h. present City's cases to the District Attorney
or City Attorney for prosecution of animal
related violations,
i. investigate and license City's kennels (as
defined in Chapter 6, Division 2, Title 6 of
the San Diego Code).
Department will provide above Field Services for the
City twenty-four (24) hours-day, seven (7) days per week as the
need arises or as requests for services are made by City
residents, in accordance with adopted response/service priorities
and within staffing limits. Department will charge Service Hours
in accordance to service billing procedures adopted by Department,
as approved by the County Auditor and Controller. Current
procedures are shown in Attachment 2. Animal Control Field
Officers will be available for City services seven (7) days per
week between the hours of 6:OO A.M. and 1O:OO P.M. "At all other
times services will be performed on a stand-by basis.
For Licensing Services, the County will:

a. maintain a current dog license file of City's
licensed and delinquent dogs and owners;
b. issue new and renewed licenses to City dog

c. conduct follow-up enforcement of vaccinated
but unlicensed City dogs;
d. schedule rabies vaccination clinics for City
animal owners ;
e. conduct periodic license canvassing programs
within City;
f. manage computer support for department
operations in support of services to City.
For Medical Services
a. maintain on-site veterinarian services for
holding Shelters;
b. contract for 24-hour emergency medical
treatment for City's injured animals;
c. inoculate City animals in care of the
Department;
d, develop rabies control resource information
for City residents;
e. monitor City's quarantine biter animals.
Such service shall include the enforcement of State
statutes and such municipal animal control ordinance as the City
may adopt pursuant to paragraph 8 of this agreement.
Dead animal pick-up services are specifically excluded
from this contract.

2. To facilitate the performance of said functions, it
is hereby agreed that the County shall have full cooperation and
assistance from the City, its officers, agents, and employees.
. .. 3. For the purpose of performing said functions,
County shall furnish and supply all necessary personnel, labor,
supervision, equipment and supplies necessary to maintain the
level of service to be rendered hereunder.
4. All persons employed in the performance of such
services and functions for City pursuant to this agreement shall
be County employees. No City employee shall perform services or
functions which County is obligated to provide under their
agreement. All persons employed by the County to perform the
services pursuant to this agreement shall be entitled solely to
the rights and privileges given to County employees and shall not
be entitled, as a result of providing services pursuant to this
agreement, to any additional rights and privileges given to City
employees.
For the purpose of performing Animal Control services
and functions under this agreement, and for the purpose of giving
official status to the performance thereof where necessary, every
County officer and employee engaged in the performance of any
service hereunder shall be deemed to be an agent of City while
performing services for City, which services are within the scope
of this agreement and are purely municipal functions.
Notwithstanding the agency relationship created by this paragraph,
the City shall not be liable for any act or omission of any County

officer or employee unless otherwise specifically provided
elsewhere in this agreement.
5. City shall not be liable for the direct payment of
._ any salaries, wages, or other compensation to any County personnel
performing services hereunder for County or any liability other
than that provided for in this agreement.
Except as herein otherwise specified, the City shall not
be liable for compensation or indemnity to any County employee for
injury or sickness or other claims arising out of his or her
employment.
6. County shall defend, indemnify, protect, and hold
City and its agents, officers and employees harmless from and
against any and al.1 claims asserted or liability established for
damages or injuries to any person or property, including injury to
County's employees, agents or officers which arise from or are
connected with or are caused or claimed to be caused by the acts
or omissions of County, and its agents, officers or employees, in
performing the agreement or services herein; provided, however,
that County's duty to indemnify and hold harmless shall not
include any claims or liability arising from the misconduct of the
City its agents, officers or employees.
7. This Basic Agreement shall not impose upon the
District Attorney of the County or the County Counsel obligation
to prosecute violations of the City Municipal Code other than such
obligation as may be imposed by law. The City may prosecute
violations of the City Municipal Code and cooperate in giving the

Department of Animal Control opinions and advice with respect to
the enforcement of such City ordinances.
8. Notwithstanding anything to the contrary herein
._ contained, this contract shall be terminated at any time that City
fails to enact and to maintain in full force and effect, including
the amount of fees provided? an ordinance identical to, or adopts
by reference the provisions of Chapter 6, Division 2, Title 6 of
the San Diego County Code, unless any deviations are specifically
agreed to by the County Director of Animal Control (San Diego
County Animal Control Ordinance No. 7182). This contract shall
also be terminated if the County requests that the City enact
amendments to said ordinance to comply with amendments to Chapter
6, Division 2, Title 6 of the San Diego Code adopted by the Board
of Supervisors and such amendments are not made within 120 days of
this request.
9. For and in consideration of animal control services
by County, City agrees ,that it shall pay the full cost to the
County Of providing such services at rates determined by the
County of San Diego and established under Item #11 herein. City
further agrees that County may keep and retain any and all license
and other fees specified in the Animal Control Services Fee
Resolution collected by the County pursuant to this agreement, and
County agrees to credit such collections against City's obligation
to pay the full cost of animal control services. ..
The County agrees, through the Department of Animal
Control to provide within 30 days of adoption of this agreement
and, on or before January 15th of each year thereafter, an

estimate of the total costs and revenue and resulting net charges
for all animal control services to be provided to the City for the
following fiscal year.
A billing period is one of the thirteen time intervals,
each being four-weeks except for the 1st and 13th in each fiscal
year, used by County in its Accounting and Resource Management
System (ARMS). On or before fifteen (15) working days following
the close of each billing period, the County shall provide City
either 1) an invoice for the amount of any deficit in the prior
billing period total revenue as compared to total animal control
service costs; or 2) a notice of refund due to City of any revenue
collected which exceeds the total animal control service costs.
Any cumulative balance due' the County from the City or the City
from the County that is under Two Hundred Fifty dollars ($250)
shall be carried forward to the next billing period, except that
all balances due, except as otherwise provided for, are payable
within sixty (60) working days of the final billing period of any
fiscal year.
The County agrees that the maximum amount of net billed
charges which the City is required to pay in 1987-88 will not
exceed one hundred and ten (110%) percent of the estimated amount
for 1987-88 furnished to the City pursuant to this Section or One
Hundred dollars ($100) whichever is greater. For any net charges
in excess of this maximum, the City shall, at its option, pay the
remaining balance as part of the thirteenth (13) billing or any
additional billing resulting from end of fiscal year adjustments
or, carry over the balance for payment in the 1988-89 fiscal year.

Should the amount billed City exceed the actual net cost
incurred, the County shall adjust the difference as part of the
thirteenth (13) billing.

Beginning in fiscal year 1988-89, no net charges billed,
nor any refunds due, can be carried forward to the following
fiscal year.
It is agreed that in performing the services pursuant to
this agreement, the County shall have all the powers of the City
and shall receive all cooperation possible from City to enable
efficient enforcement of such ordinances as specified in
Paragraph 8 of this agreement and to effectuate collections called
for thereunder.
10. This contract shall become effective on the date
hereinabove first mentioned and shall run for a period ending
June 30, 1988, and at the option of the City Council of the City,
with the consent of the Board of Supervisors of County, shall be
renewable thereafter for an additional period of not to exceed
five (5) years.
In event the City desires to renew this agreement for an
additional period not to exceed five-years, the City Council
shall not later than the tenth of December, 1987, notify the Board
of Supervisors of County that it wishes to renew the same,
whereupon the Board of Supervisors, not later than the last day of
February, 1988, shall notify the City Council in writing of its
willingness to accept such renewal. Otherwise, such agreement
shall finally terminate at the end of the aforedescribed period.

The County or City may terminate this agreement as of
the first day of July of any year provided that notice of intent
to terminate this agreement is provided in writing to the other
party at least 30 days prior to date of termination..
11. City agrees that whenever animals or persons from
within the boundaries of the City are accorded Animal Control
Services by County, the City shall pay for the services to said
persons or for said animals at the following rates:

The foregoing rates shall be adjusted by the County each
ARMS period to reflect the cost of such service in accordance
with the policies and procedures for the determination of such
rate as adopted by the Board of Supervisors of County.
All services rendered hereunder are subject to the
limitations of the provisions of Section 23008 of the Government
Code, and in accordance therewith, before any services are
rendered pursuant hereto, an amount equal to one-hundred ten
percent (110%) the estimated annual net charges shall be budgeted
by the City from its funds to ensure payment for work, services or
materials provided hereunder.
13. The County through its Department of Animal Control
shall render to said City within fifteen (15) working days after
the close of each billing period an itemized invoice which covers
all services performed during said billing period, and said City
shall pay County therefore within thirty (30) days of receipt of
the invoice.
If such payments provided above and in Section 9 of this
contract are not delivered to the County office which is described
on said invoices within thirty (30) days of the date of receipt of
the invoice, the County is entitled to recover interest thereon.
Interest shall be calculated at the rate of seven (7) percent per
annum on any unpaid portion thereof calculated from the last day
of the month in which the services were performed. 1.
14. If such payments are not delivered to the County
office which is described on said invoice within thirty (30) days
of the date of receipt of the invoice, the County may satisfy such

indebtedness, including interest thereon, from any funds of the
City on deposit with the County without giving further notice to
City of County's intention to do so.
15. The County agrees to keep separate records 'for each
- City in such form and manner as the County Auditor & Controller
shall specify. All records evidencing services to City shall be
open for examination and audit by said City during all business
hours.
16. The County agrees to maintain its kennels and
animal shelter in a humane manner and keep said premises in a
sanitary condition at all times and that all services furnished by
it hereunder shall be in accordance with the laws of the State of
California and that it wiil give the prescribed notices and use
humane methods of care and destruction of any animal coming'under
its jurisdiction.
17. The Carlsbad City Council encourages the County to continue
its animal shelter practice of not providing animals from the North County
Shelter for research purposes. The County shall notify the City of Carlsbad
in advance of any changes in this practice. At an annual review, the City
Manager shall determine that there has been no change in County animal control
policy that would result in the sale to UCSD of animals picked up in
Carlsbad.

The following report provides a general overview and then detailed
descriptions of the methodology used in the determination of the costs for services to charge the cities under the Board of
Supervisors' Policy B-?9.

I. DESCRIPTION OF SERVICE/COST CENTERS
As the Department of Animal Control does not provide a single patrol/ service rate which incorporates all department services
(such as that provided by the Sheriff), it identified the basic
types of services delivered. Field, Shelter, Medical and Licensing are the basic areas that cover the scope of the Department's activities. Not all Field activities result in an
impound; not all impounds are injuries; and not all dogs are licensed. This breakdown of the Department's activities allows
the County to charge the cities only for those sepvices that the
city receives.
The basis for developing the charges for services to the cities is
in the four basic types of services delivered (they each are a
cost center 1 :

A. Field Services - responding to requests for specific
B. Shelter Services - processing and the caring of animals services, patrol, investigations, etc.
at each of the Shelters, hearings, adoptions, etc,.
C. Licensing Services - the processing of mailed license applications, the central management of license records, development and maintenance of the Animal Management Information System.
D. Medical Services - performing routine and emergency
medical services to animals in the care of the County.
11. DETERMINING THE DIRECT SERVICE UNIT OF MEASURE
Using these four types of services, charges to cities are determined by the level of actual use of these direct services, and the actual costs allocated to these services in the billing
period. The unit rate is determined for actual costs for the billing period rather than a unit rate based upon annual budgeted expenditure levels which are subject to changes and require an extensive year end adjustment process. With this methodology, minimal' year end' adjustments are needed. The direct units of measure are as follows:
FIELD SERVICES
For Field Services, the unit of measure is an hour of Field
Officer's time. Field Officers can be ACOII's or 111's. These are the employees that provide the direct Field Service to the public. Their work is recorded on Quarantine and Service Reports.
These identify the who, what, where, when and why for the majority of the activities. The balance of the time is spent in training, administrative work related to the Service Reports, court time, etc. As our current record keeping does not provide for assigning
this non-service report time to a specific city, the time is
spread to the cities in the same proportion as the percentage of
Service Report time.
SHELTER SERVICES
The unit of measure for the Shelter is an impounded animal. The costs for Shelter activity is directly proportional to the number of impounds. The law prescribes certain time 'limits of the boarding of impounded animals. The care and feeding of the animals is done collectively. One can't determine in a feasible way the amount of time a certain animal gets of kennel disinfecting, feeding, washing, etc. Given the nature of this
activity, the cities will be charged according to the number of

animals impounded; not the treatment or the length of stay
accorded a specific animal while in the custody of the department,
or whether it is put up for adoption.
MEDICAL SERVICES
The unit of measure for medical services is an injured animal.
While records are kept of medical services given to each injured animal, the cities will be billed for the number of injured animals; not the extent of that animal's injuries and subsequent treatment by emergency clinics or the Department's Veterinarian.
LICENSING SERVICES
Licensing Services' unit of measure is an issued license. Entry
records are kept by jurisdiction, on a daily and billing period
basis. Time spent by the Licensing Staff in performing this and
related functions is directly accounted for by the Department.
The cities will be billed for the number of licenses issued during
the billing period.
111. APPLICATION OF DEPARTMENT AND COUNTY INDIRECT CHARGES - A-87
The A-87 Methodology is well established and won't be re.peated
here. What is important to understand is the spreading of the Department's indirect overhead and of the County's indirect overhead within the Department.
The allowable A-87 charges are detailed in Attachment C (The figures provided in this attachment are for demonstration purposes only and are not binding upon parties to this agreement). These allocations are determined by the County Auditor and Controller.
These costs are spread to the Department Cost Centers based upon
the cost center's share of staff years. Below is the breakdown of
the current allocation of staff years:

based upon the share of staff years. Added to the direct and
external cost of operation are the supervision and Department
overhead costs. Those costs are broken down as follows:

IV. BUILDING A UNIT COST CHARGE (see Table 1)
As noted earlier, unit costs are determined at the close of the ARMS Period, and actual charges, less revenues, are cahulateg,
The specific data collected and the subsequent calculations are
noted below. Generally, all Department staff are coded on their time sheets for accounting purposes. Time spent on non-routine
service duties (i.e, light duty at the shelter) are manually coded
to reflect the difference. Similar coding is done for services
and supplies and fixed assets, where specified. These costs are collected by the program side of ARMS.
Added to these direct charges for the Cost Center is the
Department and County A-87 allocations. Collectively, these costs represent the total cost of delivering services during that
ARMS period.
A.FIELD SERVICES
For field services, the total amount of direct
services incurred during that ARMS period is determined from the Quarantine and Service Reports submitted during that period, These are processed within two weeks after the date of occurrence, Quarantine and Service Reports are only com'pleted by Field Officers. No time is collected for any
supervisory personnel, even if they are involved on a call,
Costs for Field Services are determined by: * Tallying the actual number of service hours that were paid for Animal Control
officer IX/III's in the billing period; * Assigning all Field supervision salaries
and benefits actually paid; * Assigning all actual services and
supplies identified for Field Services; * Assigning a pro rata share of the Department and County overhead, as
allowed by A-87 (The share being the
ratio of staff years applicable to Field
Services).
.. B. SHELTER SERVICES
The process here is similar. All shelter related personnel, services and supplies and fixed assets are coded for collection by the program side of
ARMS. These are totaled with the proportionate

share of the Department and County overhead to determine total Cost Center charges.
Total number of impounds are 'also being tallied.
Unit cost for the delivery of shelter services is
calculated by dividing the total costs by the number of impounds in that ARMS period. Data is
collected which can tell us in which jurisdiction
the animal was picked up, Knowing the total number
of animals impounded from each jurisdiction, we multiply the rate for that billing period times the number of impounds to determine the impound charges for the city.
Revenues collected at the shelter are then credited to each city to determine the net charge for
Shelter services for the specific jurisdiction,
C. MEDICAL SERVICES
The number of injured animals in an ARMS period is
also recorded. Total costs divided by the number
of injured animals in that period determines the
unit cost for medical services. This cost, times
the number of injured animals from a specific city,
determines the charge for the city in that ARMS
period. Revenues collected are credited to each
city to determine the net medical charges.
D. LICENSE SERVICES
Licensing Services costs are developed in the same manner. Calculations of the revenue offset differs
